15 <br />MINUTES OF A SPECIAL MEETING OF COUNCII. <br />Mayfield Village <br />February 3, 1992 <br />The Council of Mayfield Village met in Special Session on Monday, February 3, 1992, at <br />nine o'clock p.m. (9 p.m.) in the Council Chambers at the Village Hall. Council President <br />Bruce Rinker presided. <br />ROLL CALL: <br />Present: Mr. Busa, Mrs. Cinco, Mr. Ferrante, Mr. Fixler, Mr. Flynn, and <br />Mr. Rinker <br />Absent: Mr. Basile <br />Also Present: Mayor Pietrafese, Mr. Amendola, Mr. Diemert, Mr. Hovancsek, <br />Chief Mohr, Chief Stevens, and Miss Heath. <br />Mayor Pietrafese said he would like to send a letter to the voters with Council's approval. <br />Mayor Pietrafese said he received information regarding a plan to discontinue the use of <br />steady burn lights on barrels at construction zones. He would also like Council's approval <br />to send letters expressing our wish to retain the use of the steady burn lights. (He <br />distributed copies of the letters and additional inforniation to Council.) <br />Council expressed no objections to the letters being sent. <br />Mayor Pietrafese said he wants to talk about the LaConte Golf Course but thinks Council <br />should adjourn into Executive Session to do so. <br />Mr. Rinker said, as Mr. Diemert indicated earlier, we have had a flurry of litigation action <br />which should be discussed in Executive Session pursuant to Statute. The issues for <br />discussion in Executive Session are: LaConte/Purchase of Golf Course; Referendum <br />petition bestowed upon us with a taxpayers' letter; and the lirigarion from Mayfield Heights <br />residents. <br />Mrs. Cinco, seconded by Mr. Ferrante, made a motion to recess into Executive Session to <br />discuss the above-mentioned lirigation matters. Mr. Pat Caricchio, in the audience. said the referendum peririons aze not part of litigarion <br />and should not be discussed in Executive Session. <br />Mr. Diemert said the referendum is tied into the LaConte litigation intimately. With the <br />2506 appeal which is included in the taxpayers' letter which has been received threatening <br />the litigation, he does not see how any aspect of the variance could be discussed without <br />jeopardizing their position. Mr. Diemert said he would not advise they talk about any <br />aspect of the variance without doing so in Execurive Session. <br />ROLL CALL: AYES: Mr. Busa, Mrs. Cinco, Mr. Ferrante, Mr. Flynn, and Mr. Rinker <br />NAYS: Mr. Fixler Motion Carried
