RESOLUTION 2022-43 <br />INTRODUCED BY: Mayor Bodnar <br />AN EMERGENCY RESOLUTION AUTHORIZING THE DIRECTOR OF FINANCE TO <br />ESTABLISH A VILLAGE LOCAL ONEOHIO OPIOID SETTLEMENT FUND IN <br />ORDER TO RECEIVE, ACCOUNT FOR, AND SPEND ONEOHIO OPIOID <br />LITIGATION SETTLEMENT FUNDS <br />WHEREAS, the State of Ohio reached an $808 million settlement agreement with the three <br />largest distributors of opioids; and <br />WHEREAS, the State, with the knowledge, consent, and participation of its political <br />subdivisions, developed the OneOhio Plan, a mechanism to ensure that any money from the <br />negotiated settlement is distributed fairly to the communities hit hardest by the opioid crisis; and <br />WHEREAS, the settlement agreement allocates 30% to local governments (LG Share), <br />55% to a foundation that will distribute funds to projects, and 15% to the Office of the Ohio <br />Attorney General as Counsel for the State of Ohio; and <br />WHEREAS, on March 10, 2022, the Auditor of State issued Bulletin 2022-003 setting <br />forth guidelines for accounting for and utilizing OneOhio Plan LG Share monies, including the <br />requirement for local government subdivisions to establish a separate special revenue fund for the <br />receipt and expenditure of the settlement monies; and <br />WHEREAS, it is the desire of Council to establish the "OneOhio Opioid Settlement Fund" <br />in order to deposit any settlement monies received. <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the Village of Mayfield, <br />County of Cuyahoga and State of Ohio, that: <br />SECTION 1. Mayfield Village Council hereby authorizes the Director of Finance to <br />establish a Village local special revenue fund titled the OneOhio Opioid Settlement Fund in order <br />to receive, account for, and spend OneOhio opioid settlement funds distributed to the Village. <br />SECTION 2. The Council finds and determines that all formal actions of this Council <br />relating to the adoption of this Resolution have been taken at open meetings of this Council; and <br />that deliberations of this Council and of its committees, resulting in such formal action, took place <br />in meetings open to the public, in compliance with all statutory requirements including <br />requirements of Section 121.22 of the Ohio Revised Code. <br />
