Mr. Burns advised the Building Com- <br />missioner that Planning Commission has been advised that the screen- <br />ing method using the fence along the property line is not working and <br />pursuant to our approval on December 9th we now request that they <br />submit a substitute method. Councilman Tallon asked Mr. Spino to <br />check out the other violations. In. reference to the speaker, Mr. Spino <br />stated tie had been told that the speaker was located where it was <br />shown on the plans. Mrse Beck, an adjacent neighbor, stated that they <br />have been advised by Law Director Gareau that if a stipuTation is <br />stated in the minutes of a meeting, this stipulation can be enforced. <br />She is questioning who they can eontact when the Building_ Department <br />does not enforce what is in the minutes and also questioning why the <br />temporary occupancy cannot be revoked and the restaurant closed. <br />Councilman Wilamosky also remembered the dialogue about the two fences, <br />and stated that the Building Commissioner should enforce what the <br />Planning Commission stipulates. Assistant Law Director Dubelko <br />stated that under the conditions of Planning Commission's approval <br />if the screening does not work, the developers must return to the <br />Planning Commission to resolve the problems, if he does not return, <br />the temporary oecupancy can be revoked;. and sinee the minutes of <br />9pxil 8th stated tliat the speakers would be directed away from the <br />residential area, tti3s. too should be addressed-. The Building Commis- <br />s1oner will notify David Salisbury, attorney for- Kenn,y Kings, that <br />they must retum; to.Planning Commission for review of these violations., <br />2) Review and Cor-rection of the Minutes of April 22, 1986. <br />B'.
