<br />CITY OF NORTH OLMSTED <br />BOARD OF ZONING APPEALS <br />MINUTES - NOVEMBER 11, 1987 <br />Chairman Remmel called the meeting to.order at 7:35 p.m. <br />Present: R. Bugala, R. Gomersall, B. Grace, and C. Remmel <br />Absent: J. Helon <br />Also Present: Law Director M. Gareau, Building Commissioner D. Conway, and <br />Clerk of Commissions B. Oring. <br />R. Bugala moved to accept the minutes of the October 7, 1987 meeting as written, seconded by R. Gomersall, and unanimously anproved: <br />1. Mr. and Mrs. J. Naccarato, 3111 West 230th St. <br />Request for.variance (1123.12).. Request 14 foot rear vard variance for natio <br />enclosure. Violation of Ord. 87-93, Section 1135.08. Also request special <br />permit to add to non-conforming dwelling. Special permit required O.rd.. 87-93, <br />Section 1165.02. <br />Chairman Remmel called all interested parties before the Board. The_oath was <br />administered to A. Kemn, Patio Enclosures. Chairman.Remmel observed that thex'e' <br />would seem to be enough.room. R. Bugala moved to grant the 14 foot rear.yard <br />variance f_or a natio enclosure for Mr. and P1rs. J..Naccarato at 3111 West 230th <br />Street, and the special permit, s.econded by C. Remmel, and unanimousl_y apnroved.. <br />Variance and special permit granted. <br />2, Charles Helzer, 31266 Bradley Road ' . <br />Req_uest for variance (1123.12). Request 8 foot side yard variance for building <br />in Limited Industrial Area. Violation of-Ord. 87-93, Section 1145.08: Also <br />. request variance to use gravel in parking area and"driveway. Violation of <br />Ord. 87-93, Section 1161.10. <br />Chairman Remmel called all interested parties before the Board. The• oath was <br />administered to Mr. Helzer and Mr. Nestoff, a'neighbor. Mr. Bugala stated <br />that.he does not remember giving a variance for a gravel drive and parking <br />area for the,first building. Building Commissioner Conway stated that a <br />variance should have been requested a few years ago, but as he understands it <br />a certificate of occunancy has never been issued and the drive and parking <br />area should have been paved.. The frame of the new building is up and <br />matches the•set back of the existing building. T.aw Director Gareau q.uestioned <br />why the gravel has not been paued, since others are forced to pave these areas, <br />he should'?be too. Mr. Helzer cla3.ms that he was told he only had to vave the <br />apron. Mr. Nestoff, the adjacent neighbor, presented pictures of the buildings <br />and stated that they were too close to his property. Mr. Helzer stated that <br />at the time he built the first building he was told that he needed a 10 foot <br />side yard. Mr. Grace believes that to make him change the location of the <br />building would be a hardship. B. Grace moved to grant the req.uest for the 8 <br />foot side yard set b ack, seconded by C. Remmel, and unanimously approved. <br />Variance approved. C. Remmel moved to grant a variance to use gravel in a <br />parking area and in the driveway, seconded by B. Grace. Roll call on motion: <br />Remmel, Grace, Bugala, and Gomersall, no. Motion failed to pass. Variance <br />denied.
