?_ • <br />I.- <br />BOARD OF ZONING APPEALS <br />OCTOBER 7, 1987 PAGE 2. <br />3. Robert Brennan, 4575 Martin Dr. " <br />ReQUest for snecial permit (1123.12). Request 44 square foot variance and <br />location variance for tool shed. Violation of Ord. 87-93, Section 1135.02(d)-1. <br />Chairman Remmel called all interested parties before the Board. The oath was <br />administered to Mr. Brennan and Mr. Neff, contractor. Board agrees that <br />addition would 1ie an imnrovement. B. Grace moved to anprove the request for <br />a special permit to add to a non-conforming dwelling (front set back) for <br />Mr. Robert Brennan, 4575 Martin Dr., seconded by R. Gomersall, and unanimously <br />annroved. SDecial permit granted. <br />4. Elias Brothers'Restaurants, Inc, 26770 Lorain Rd. <br />Request for variance (1123.12). Request 240.88 sa.uare toot variance for total <br />sign area. (224 sq, ft. over allowance at present arid request 16.88 sq. ft. <br />for statue). Violation of Ord. 87-93, Section 1163.06(b) &(d). <br />Chairman Remmel called all interested varties before the Board. The oath was <br />administered to Mr. Havilak, renresenting Elias Brothers who stated that the <br />"Big Boy" statue is their logo and is displayed at their other locations. A <br />nrevious owner had removed it at this restaurant. Mr. Bugala stated that they <br />were over their allotted sign area at present,. and he could see no reason to <br />exnand on that. He also pointed out th at the configuration of the sign did <br />not conform to code and others might want statues that were ob.jectionable. <br />Law Director Gareau stated that if they reduced the size of their pole sign, <br />which is huge, to the conforming 50 square feet, the Board might be more <br />willing to anvrove the "Big Boy".. Building Commissioner Conway advised that <br />the statue would have to be referred to the Planning Commission if a variance <br />is granted. R. Bugala moved.to grant the 240.88 sauare foot variarice for <br />total sign area for Elias Brothers! Restaurants, at 26770 Lorain Road to con- <br />struct or place a statue on their vronerty, seconded by B. Grace. Roll call <br />on motion: Bugala, Grace, Gomersall-, and Remmel, no. Motion failed to'pass. <br />Variance denied. <br />5. Pheasants' Wa1k Subdivision (Hennie Homes), north of Lorain Road, east of <br />Wellesley Ave. <br />Request for •vaziance (1123.12)_. Request 20 foot rear yard variance on all <br />sublots. Violation of Ord, 87-93, Section 1135.08. <br />Chairman Remmel called all interested parties before the Board. The oath was <br />administered to Mrs. Colbv, Mr. and Mrs. Spenser, Mr. and Mrs. Pa1ko, Mrs.. <br />Canella, J.Denpisch, S. Staufert, M. Kacirek, C. Trunk, and J. Yuhas,.all - <br />adj acent propertyo uwners and Mr. Welke and Mr. Moss, attorney, both repre- . <br />senting Hennie Homes. Chairman Remmel distributed conies of a letter from . <br />Bruce and Bonnie Colby advising that they would not comply with req ' uest. <br />Chairman Remmel read a letter from Hennie Homes advising that they are <br />requesting a blanket variance as they had vreviously been granted for other <br />subdivisions. Mr. Moss presented a.plan showing which lots might require <br />variances for certain homes. Mr. Welke stated as an examule if their <br />"Ashley" model, their deevest house, were to be selected for sublot.2; a?16 <br />foot rear yard variance would be req_uired, if any of the other models were <br />chosen, no variance would be.required. The maximum variance required would <br />be 18.33 feet, the minimum would be 5.33 feet. Mr. Moss exnlained that the,y <br />had no way of knowing which model would be chosen for which lot. Chairman <br />Remmel stated that if a blanket variance were gr.anted, the City would have <br />no. control. Mr. Bugala believes that they should have designed houses that <br />.
