<br />BOARD OF ZONING APPEALS APRIL 1, 1987 PAGE 5 <br />and is not solid. The Board agreed that" a patio screen would be sufficient <br />and he could get this without a variance.R. Bugala moved to grant the <br />l foot variance for the fence and a variance for a fence on a corner lot <br />which is not 90% open, seconded by C. Remmel. Roll call on motion: Bugala, <br />Remmel, Gomersall,-and Helon, no. Motion failed to pass. Variance denied. <br />12. Thomas Pekar, 5185 Whitethorn Ave: <br />Request for special permit to add°to non-conforming dwelling (front set back). <br />Special permission required Ord. 62-33, Section 1231.02. <br />Chairman Remmel called all interested parties before the Board. The oath <br />was administered to Mr: Pekar, B. Brown, the contractor, and R. Connor, <br />a.neighbor, who had no objection. Board has no problem with the special <br />permit.. R. Bugala moved to grant the speeial fo ad'd to a non-cofnorming <br />dwelling (front set back) for Thomas Pekar at 5185 Whitethorn Ave,., seeond'ed <br />lig J. Helon,, and unanimousTy approved.: Special permit gr•anted. <br />13.; S'ubur•ban Auto Body, 4960 Dover Center Rd.. <br />Request for variance (1133.,13). Request 25 foot front set back var3ance to) <br />construct fence= and parking lot on Mill Road frontage.. (50'feet set back <br />required. as! d'etermined liy the Law Department)'. (Approved by Planning <br />Gommission February 24,. 1987). <br />Chairman Remmel calTed all interestedparties before the Board'. The oath <br />was administered to Mr. Papatto, the owner, wfio explained that the proposal <br />was approved by Planning Commission and Council to have a fenee at the 50' <br />foot set back line (fence is to be off set at the middle driveway). He is <br />requesting, to put this same fence at the 25 foot line, in order to have a <br />larger area in which to store damaged cars. He believes that the appearance <br />will be just about the same with the fence at 25 feet and will still install <br />the Iandscaping. Mr. Bugala pointed out that if the property to the west <br />was developed commercially, theg would have no visibility since they would- <br />be required to be set back at the 50 foot line. Mr. Papatto stated that <br />this would be an 8 foot fence, not a.structure, and it would be open in the <br />middl:e at the driveway. Mr. Papatto was reminded th at he could not store <br />any cars iri fron.t of the fence, that he could only park employees'` or cus- <br />tomers.J' cars which will be there for a short time. Gouncilman Tallon stated? <br />that the Council believed that they, had given him room enough to store cars <br />and they.wanted-:him to eliminate the damaged cars.being stored?on the Dover- <br />Center, <br />side witli only one row of parking in that set back. Mr. Papatto stated <br />that this. was what he is trying to do. Councilman Tallon and the Board <br />agreed that if he tries it as approved and it does not work out satisfactorily,. <br />fie could_ come back for a variance at that time, but they will not guarantee <br />that he will get a variance. Mr. Papatto,.agreed to withdraw tfie request at <br />this time. <br />Mr. Gomersall requested that all plans submitted to the-Board be to scale. <br />The meeting was adjourned at 9:25 p.m. <br />U <br />iinan B.
