w <br />IN <br />PLANNING COMMISSION -JUNE 28, 1988 PAGE 5 <br />V. COMMUNICATIONS: <br />Ord. 88-75: An ordinance creating new.chapter 1141 of the North Olmsted <br />Zoning Code, entitled "Office.Building District." Commission has discussed <br />this in committee and will continue discussion at 7:00 p.m. prior to the <br />next meeting. , <br />Ord. 88-81: An ordinance providing for the amendment of the Zone Map of.the <br />City of North Olmsted which Zone Map is part of the Zoning Code of the City <br />of North Olmsted, by changing the premises hereinafter described from Single <br />Residence B District to General Retaii Business District. Ordinace is to <br />rezone a residential lot facing Silverdale Road and abutting properties on <br />Lorain Road to General Retail. The Commission had rejected this proposal <br />previously on the-basis that it would be a further encroachment into the <br />residential area. Mr. Gorris pointed out that there is no assembly proposed <br />so this lot would not conform to the General Retail District requirements. <br />Mr. Hoyte, the adjacent property owner, objected to proposal explaining that <br />the owner had told him that he is not maintaining the property because he <br />believes that the city would be more likely to approve the rezoning if the <br />lot is not maintained. If lot is rezoned, Mr. Hoyte believes that a parking <br />lot or dumster would be only a few.feet from his house, and:advised that he <br />tried to purchase the lot on several occasions. T. Morgan moved to disapprove <br />Ord. 88-81 which is changing the zone.map by changing,the premises hereinafter <br />described from Single Resident District to General Reta-il Business District, <br />because we believe this constitutes spot zoning Which this Planning Commission <br />has been against for a good number of years; also it constitutes an encroach- <br />ment on a residential area which can also set a precedent for other areas of <br />the city; and it creates a non-conforming commercial lot, since it has neither <br />the dimensions nor the area required for a commercial lot, and with the comment <br />that the Commission had previously denied this same rezoning, seconded by <br />R. Bierman, and unanimously approved. <br />Ord. 88-78: An ordinance creating new and revised Section 1161.07 of the <br />North Olmsted Zoning Code, entitled "Parking and Storing of Commercial Tractors <br />in Residential Districts Prohibited". Assistant-Law Director Dubelko advised <br />that the present ordinance prohibits the parking of trucks of one ton or - <br />more in a residential neighborhood; when a resident of Timber Trails Subdivision <br />was taken to court for parking a tractor trailer on his residential property, <br />the judge stated that there was not enough guidance in the ordinance. This <br />proposed ordinance is an attempt to resolve this probleth.-. The Commission <br />believes that there are many types'of trucks, other than tractor trailers, <br />which would be just as offensive in residential neighborhoods. B. Gorris <br />moved to reject Ord. 88-78 on the basis that we feel definition 1161.07(b) <br />is too narrowly drawn and does not cover all catagories of vehicles which <br />should be prohibited in a residential district, seconded by R. Bierman, and <br />unanimously approved. <br />A letter from the President of Council:Janet.Saringer requesting that twa <br />members of the Commission be appointed to serv.e on a committe:e with repre- <br />sentatives of Council, tlie Law Department and;others in the administration <br />who will work with the newly hired City Planner. J. Thomas moved to appoint <br />Mr. Morgan and Mr. Gorris to serve on this committee and with 14r. Biernian as <br />the alternate, seconded by M. Betts, and unanimously approved-. Mr. Morgan
