4t_ . '• a <br />CITY OF NORTH OLMSTED <br />"PLANNING COMMISSION <br />MINUTES-OCTOBER 25, 1988 <br />I. ROLL CALL: <br />Chairman Morgan called the meeting to order at 8:00 p.m. <br />Present: M. Betts, R. Bierman, J. Thomas, and T. Morgan <br />Absent: B. Gorris, R. Bowen, and E. Traczyk <br />Also Present: Assistant Law Director J. Dubelko, Building Commissioner <br />D. Conway, and Clerk of Commissions B. Oring <br />II. REVIEW AND CORRECTION OF MINUTES: <br />R. Bierman moved to accept the minutes of October 11, 1988, seconded by . <br />J. Thomas, and unanimously approved. <br />III. BUILDING DEPARTMENT REQUESTS: <br />1) GTE Mobilnet, Inc., 25151 Brookpark Road <br />Amendment to detailed development plan (Mixed Use District); to wit, <br />changing one suite of an apartment to a business use. . <br />Tabled by Planning Commission October 11, 1988. <br />Chairman Morgan advised that the Fire Department had no objection to the plan <br />as pro.posed providing fire protection is provided and the.Police Department <br />stated no objection. Chairman Morgan stated that a letter dated October 14th <br />(see attached) was submitted to the Building Commissioner responding to the <br />concerns of the Commission regarding noise, interference, and safety to the <br />residents of the apartments,,pointing out that an alternative to this plan <br />would be to construct a 200 foot tower. Building Commissioner Conway believed <br />that the DBA ratings were high and Mr. Morgan agreed that 80 to 85 was high.. <br />Mr: Rafferty and Mr. Pitchure, representing the developer, explained that . <br />these are approximate levels taken at a short distance from the equipment, <br />and tapers off drastically as the distance is increased. Mr. Conway noted <br />that the HVAC unit is directly on the wall adjacent to the tenant's unit. <br />He believed that the separation should be increased, some sound deadening <br />material should be added, and perhaps the unit should be isolated, pointing <br />out that vibrations can be a problem in this type of building. Mr. Rafferty <br />advised that all sound coming from the equipment is generated from the cooling <br />fans which are located on the back of the unit. City Engineer Boyer stated <br />that he had no problem with the plans from an.engineering standpoint. Assis- <br />tant Law Director Dubelko advised that when the code was amended to allow <br />retail uses in a Mixed Use District this type situation was not contemplated <br />but there is nothing in the code to prohibit this use, and the Commission can <br />allow it 'rovided it is integrated into the plan, but cautioned that when a <br />retail and residential use is mixed in.such a close proximity, Planning <br />Commission must make sure.the health, welfare, and safety of the surrounding <br />residents is protected. Mr. Pitchur explained that the 6 inch thickness of <br />the walls in the unit was visually.inspected, but they could not verify the <br />actual thickness in the corridor, but by code it should also be 6 inches. <br />Mr. Betts did not believe that sound would travel through 6 inch walls. Mr. <br />Conway was concerned about vibration also, and would like the authority to <br />address these issues. The developers stated that there were methods to mini- <br />mize vibrations and they would rectify any situation that was bothering <br />their neighbors. Mr. Morgan believed that this is a good use and that any <br />noise problems could be addressed by the Building Commissioner. He does have
