? <br />? <br />PLANNING COMMISSION JUNE 13, 1989 PAGE 2 <br />Mr. Conway further advised that the seating was increased after the oc- <br />cupancy permit was issued. Mr. Nemeth advised that in the future he <br />did intend to build another building (at which time the house would be <br />removed) and if he added the 50 spaces now, he would only have to add <br />60 more for the new building. Mr. Morgan pointed out that there was <br />only one drive to the property now, but questioned if a second drive should <br />be considered for the future development. Assistant Law Director Dubelko <br />advised that the future expansion should be considered. Mr. Bierman <br />questioned why the beauty parlor and a pizza delivery outlet would require <br />more spaces. Mr. Nemeth stated that the beauty parlor was open some <br />evenings and there was a conflict. Mr. Thomas questioned why Mr. Nemeth <br />could not control his tenants especially when he is living on the property, <br />and al.so asked how he was planning to buffer the property from the neighbors. <br />Mr. .Nemeth responded that the neighbors are approximately 150 to 200 feet <br />away from the parking lot (his house is about 20 feet away); he believes <br />that the owners of the bar should control their patrons; arid stated that <br />he operated the bar for a,year and a half and had very few complaints. <br />A resident, Mr. McCloud, was advised that a bar is permitted use in the <br />General Retail District. Mr. Becker believes that this situation will not <br />get better unless something is done and also advised that the firemen at <br />the adjacent fire station are being disturbed. rirs. Johnson, who ownes the <br />residence and the business next door, complained that their customers are <br />parking in her lot and are littering her property. Mr. Lizanich stated <br />that it was clear that they needed the parking, but wanted a buff_er around <br />the entire lot. One of the owners apologized for the noise, and stated <br />that they are trying to keep the noise down, but stated that he is con- <br />cerned that his customers are parking in other lots, especially since some <br />of them park across Lorain Road. Mrs. Bahas, Councilwoman, suggested that <br />they hire a parking lot guard. The owner stated that there were times <br />when the palice were called and they could hear no noise, but this still <br />was considered a complaint. Mr. Thomas advised that since these complaints <br />to the police and those to the Board of Liquor Control are going to cause <br />them problems, it would be to their advantage to control the customers; and <br />also that the Commission was going to make sure that there was appropriate <br />buffering, and it would be between Mr. Nemeth and the owners as to who <br />iaould bare tfie cost. Chairman Thomas stated that since these plans are not <br />complete, he would suggested that A'Ir. Nemeth confer with someone in the <br />Building Department as to what actually was needed, and suggested that <br />landscaping (including any trees to be removed),lighting, traffic flocJ, <br />location and type of dumpster enclosures, and finally some very good <br />buffering around the entire property including the fire station be included <br />in the p'laus. Mr. Morgan suggested that the west drive next to the fire <br />station be closed off and the second curb cut off Lorain Road be included. <br />Since Mr. Nemeth prefered not to install the second access until the new <br />building was constructed, he was advised to at least show it on the plans. <br />Mr. Thomas suggested that these plans be withdrawn and that prior to pre- <br />senting new plans.that Mr. Nemeth take note of other buffering around the <br />city, specifically, the 9 foot sound barrier at Nightfall Nite Club and <br />the mound on the Kenny King property. Mr. Nemeth agreed to withdraw his <br />plans. <br />Chairman Thomas advised that item number l, Home Centers, would be heard next.
