REVIEW AND CORRECTZON OF MZNUTES: <br />J. Konold moved to accept the minutes of February 23, 1989 as written, <br />seconded by B. Schulz, and unanimously approved. <br />III. COMMUNICATI'ONS: <br />aKemo from Mre Burk regarding this evening's hea.ring, <br />IV. HEARINGS: <br />1) Miles Mechinical, 17706 Miles Road <br />Request for appeal (1315.08)m. To have the Board review and interpret <br />the Building Commissioners decision regarding fees for heating and <br />ventilating permits (Honors Hotel permits). Chapter 1321 of the <br />Building Code. <br />Chairman Kazak explained that Miles Mechanical was protesting the permit <br />fees for heating and ventilation permits for the Honors Hotel in regard <br />to Chapter 1321 of the Building code. Chairman Kazak administered the <br />oath to Mr. Soni, representing Miles Mechanical. Mr. Soni was advised <br />that there were only three members present which does constitute a <br />quorum, but that it requires 3 affirmative votes to approve any motion, <br />Mr. Soni indicated that he would like the request discussed at this <br />meeting. Building Commissioner Conway advised that the fee schedule for <br />heating and ventilation (section "b") is based on a per unit fee of <br />$20.00 for all units with 150,000 BTUs or less and with a$2.00 charge <br />for each additional 10,000 BTUs. The fees for air conditioning units <br />(section "d") are also $20.00 for one unit up to 3z tons with a$2,00 <br />fee for each ton or fraction of a ton over 32 tons. The Building Depart- <br />ment has interpreted this to apply to each individual unit, and since <br />each room has its own combination heating and cooling unit there is a <br />charge for both the heating and the air condition on each through-the, <br />wall unit. Mr. Soni presented his calculations which would take one <br />unit f.or each the heating and air conditioning fees and add the additional <br />ETUs for the heating and additional ton& for the air conditioning for all <br />the rest of the units. Mr. Soni cl.aimed that he had the same problem <br />in Westlake and after that city talked with their Law Department9 the <br />fees were reduced. Mr. Conway advised that most contractors ask the <br />Building Department to figure these fees for them prior to bidding a <br />job, but in this case they did not. Mr. Conway cautioned the Board that <br />if they do consider a fee change that it should be designed specifically <br />for through the wall units, since if there were an interpretatio:n that
