M-' s a <br />, p <br />PLANNING COMMISSION MARCH 27, 1990 PAGE 4 <br />aspect, the Commission is limited to doing what is possible regarding <br />parking lot buffers, etc. They cannot turn down a proposal based on <br />the fact that the bar is noisy, this must be a matter of business regu- <br />lation. Building Commissioner Conway clarified for Mr. Orlowski that <br />parking was permitted in the SO foot rear yard adjacent to residential <br />property. Mr. Dubelko further advised that the fact that the deed <br />restriction was not included as required for the assembly was not a <br />reason to. disapprove this proposal, the owner has promised to do this, <br />and if he does not do it voluntarily, he can be forced to through the <br />courts. J. Thomas moved to table this proposal until the second.meet- <br />ing in April and if the developer is not present and if our questions <br />are not answered concerning the assembly, the proposal will be disap- <br />proved, seconded by R. Bierman, an.ci unanimously approved: .:A :letter will <br />b.e:sent ta.Mr.. Nemeth notifying him that the proposal has been tabled. <br />IV. NEW DEVELOPMENTS AND SUBDIVISIONS: <br />No items. <br />V. COMMUNICATIONSo <br />No items. <br />VI. COMMITTEE REPORTS: - Prior to the meeting the"Commission met to discuss rezoning certain parcels <br />of land west of Stearns Road to new zoning classification. which are not yet <br />defined but would restrict heavy retail use. The committee will be meeting <br />again at 7:15 p.m. before the next Planning Commission meeting. Mr. Betts <br />will be identifying parcels which will conform to a new residential service <br />classification and Mr. Thomas will be defining parcels that would conform to <br />the new Mixed Use classification. Mr. Dubelko is invited to attend. In <br />reference to the question•raised at the_last meeting regarding rezoning pro- <br />perty to a Mixed Use classification which would include multi-family use, <br />Mr. Dubelko advised that such a rezoning would have to go to a referendum. <br />Members are questioning if a cluster home development would be considered <br />multi-family and this will have to be defined. The Commission is considering <br />rezoning property that fronts on Lorain, west of Stearns to,the C.E.I. ease- <br />ment to a totally new Mixed Use classification which would restric.t retail <br />and encourage lower (two story) office buildings, residential use (senior <br />housing, cluster homes, etc) to try to stop the retail corridor where it is. <br />VIIo NEW BUSINESS: <br />No items. <br />VIIIo OLD BUSINESS: <br />No items. <br />II. REVIEW AND CORRECTION OF MINUTESe (heard at this point) <br />J. Thomas moved to apprave the minutes of March 13, 1990, seconded by B. Gorris, <br />and unanimously approved. .
