It . . i. <br />?i <br />He agreed that grave sites were not feasible in the ravine. Another neighbor <br />also objected because this is a commercial operation and also believes the <br />drive will be used for the viewing area. Mr. Wilms stated that the drive <br />should not be considered until the litigation is settled. Mr.-Morgan responded <br />that the owners have a right to use their property, and the other proposal is <br />not a consideration at this time. He pointed out that the Commission cannot <br />approve this as it is, it would have to be referred to the Board of Zoning .. <br />AppeiLls. Mr. Zeigman reiterated that this proposal will solve a problem that <br />has existed for several years and is becoming more of a problem since the <br />trees are larger and more easily damaged. Mr. McConneghy, representing Sunset <br />Memorial, mentioned other options: selling the property as one lot with the <br />driveway as an easement to Sunset or widening the frontage of parcel 2 to 80 <br />feet. Mr. Dubelko ad.vised that the City would have no jurisdiction over the <br />easement It was pointed out that the property would be harder to sell, and <br />that the driveway would have to be 80 feet at the 50 foot building line, not <br />just at street line. Mr. Dubelko further stated that if this lot split is ''- <br />approved in this way, the city is, in fact, approving a curb cut at this <br />location. The owners maintain that there is a curb cut there at present. <br />After some discussion, the representatives decided to request the variance. <br />The members agreed to forward the proposal with no recorrunendations. M. Betts <br />moved that the sunset Memorial Park Association Lot Split in regards to parcel <br />numbex 236-24-16 be referred to the Board of Zorilrig Appeals for their <br />consideration of this lot split, and as a part of this motion we are not <br />making a recommendation one way or the other to BZA as to accept or deny, <br />seconded by L. Orlowski, and tmanimously approved. The developers were <br />advised that they had to make application to the Board of Zoning Appeals for <br />the variance. <br />V. COMMUNICATIONS: <br />VI. COMNffTTEE REPORTS: <br />VII. NEW BUSINESS: <br />VIII. OLD BUSINESS: <br />Mr. Dubelko will be re-drafting the Mixed Use District Ordinance as discussed <br />at the caucus this evening and as recoirmiended by Mr. Hill. <br />Members will be meeting at 7:00 p.m. prior to the next meeting to discuss the <br />next 4 chapters of the proposed Zoning Codes. <br />Ord. 90-142 had been referred to 'the Commission by Council for the last <br />meeting. Basically this removes the limitation on terms that a chairman can <br />serve. Mr. Dubelko stated that this was recommended by the Mayor so that a <br />good chairperson would not have to be removed automatically. M. Betts moved to <br />approve Ord. 90-142 regarding the Architectural Review Board's chairman's <br />limitation, seconded by T. Morgan, and unanimously approved. <br />IX. ADJOURNAENT : <br />M.
