Mr. Quinn is <br />concerned because he was told that he did not need this in order to <br />get approval to,build on a 45 foot lot. B. Schulz moved to have an <br />engineering drawing submitted showing the drainage plan, seconded by <br />D. Spoerke, and unanimously approved. Mr. and Mrs. Quinn pointed out <br />that they need a definite approval 'or disapproval since they do have a . <br />purchase agreement and they would be released from the contract if <br />there was a disapproval and further stated that they did not want to <br />spend $700.00 for a engineering plan, if the approval to build was <br />not given. J. Kazak moved to rescind the motion to have an engineering <br />drawing submitted showing the drainage plan, seconded by D. Spoerke, <br />and unanimously approved. J. Kazak moved to accept the proposal for <br />the construction of this house on property located between 23066 and <br />23108 Virginia Ave. The motion died for a lack of a second. J. Kazak moved to deny the construction of this house an property located be- <br />tween 23066 and 23108 Virginia Avenue, seconded by D. Spoerke, and <br />unanimously approved. Request rejected. <br />2) Mark Laisy, property located between 25780 and 25746 Butternut Ridge Road. <br />Request'permission to move house from 25420 Butternut Ridge to permanent <br />parcel 236-11-3 and 236-11-4. Hearing required Ord. 63-224. (Property <br />to be assembled at Planning Commission April 24, 1990). Also request <br />variance for size of home which is less than 1,500 square feet as required <br />in the "A" Residence District and request variance for width of lot which <br />is less than 80 feet as required in the "A" Residence District. Violations <br />of Section 1334.09 of the building code. (Variance also required by_the <br />Board of Zoning Appeals to be heard on May 2, 1990 if the above permission <br />and variances are granted). <br />Chairman Kazak read the request and administered the oath to Mr. Laisy, <br />his parents, Mr. and Mrs. J. Laisy, and Mr. and Mrs. Scheeff, neighbors. <br />Mr. Kazak questioned if Mr. Laisy was planning to construct an addition <br />in order to make the house conform to the "A" District requirements. <br />Building Commissioner Conway explained that Chapter 1334.09(b) of the <br />Building Code prohibits putting on an a3dition in order to meet the size <br />requirements when a house is being moved. (Please note: agenda states - <br />section 1134.09 and should read 1334.09). Mr. Kazak pointed out that <br />there were other homes on that street which do not meet the size re- <br />quirements. It was also noted that this house was presently on Butternut <br />Ridge in an "A" District. Mr. Schulz and Mr. Scheeff are both concerned <br />that because a vacant 60 foot lot remains, it could be used as a driveway <br />from the proposed apartment complex to Butternut Ridge Road thus putting <br />more traffic on Butternut Ridgee Mr. Schulz suggested combining the two <br />60 foot lots for this house. Mr. Laisy stated that his grandparents <br />owned the other lot and were not willing to give it up. Mr. Scheeff <br />asked if there was any way to stop them from penetrating the buffer and.. putting a street through to Butternut Ridge. Building Commissioner Conway <br />explained that the Planning Commission has an approved plan which shows <br />no street onto Butternut Ridge Road and the court order states that <br />there is to be no access onto Butternut Ridge. He further clarified that <br />the house is shown at 70 feet setbaek, but they are going to the Board <br />of Zoning Appeals in order to place it 85 feet from.the sidewalk.
