Request variance for location of ground <br />sign (5 foot, 6 inch encroachment into setback). Violation of Ord. 87-93, <br />Section 1163.06-(f)2. <br />Chairman Bugala called all interested parties before the Board. The oath was <br />administered to David and Tony DiBenedetto who advised that this sign is <br />smaller than permitted by code and that the location had been shown on the <br />site plan when they received their approvals from the various Boards. They <br />were told that the location was wrong after the sign was installed. rTr. Bugala <br />believed that the contractor does have a responsibility to know what the set- <br />backs are; and nointed out their other sign needed a variance after it was <br />installed. Building Commissioner Conway advised that when a sign is presented <br />to the Boards any approvals are conaeptual. Mr. Restifo pointed out that there <br />did not seem to be a safety problem with the location. Pir. Grace stated that <br />if the sign were moved to conform they would have to put it in a parking space. <br />Mr. Bugala conceded that the street is angled in such a way that sight is not <br />impeded, but he still has a problem with contractors who do not know the codes. <br />T. Restifo moved to grant the request of Sparky Plaza at 26800 to 26900 Brookpark <br />Road Extension for a variance for the location of the ground sign, seconded by <br />B. Grace, and unanimously approved. Variance granted. <br />4. Doris Dapsis, 5477 Dorothy Dr. <br />Request for variance (1123.12). Request 12 foot rear yard variance for patio <br />enclosure. Violation of Ord. 87-93, Section 1135.08-(a). <br />Chairman Bugala cdlled all interested parties before the Board. The oath was <br />administered to Ms. Dapsis and J. Hall, contractor. Members have no problem <br />with the request. J. Helon moved to grant the request of Doris Dapsis, 5477 - <br />Dorothy Drive for a 12 foot rear yard variance for a patio enclosure, seconded <br />by R. Gomersall, and unanimously approved. Variance granted. <br />5. Day's Inn, sign location at I-480 interchange on the west side of Clague Road. <br />Request for variance ('1123.12). Request variance to place sign on property <br />ot.her than where the business is located. Also request 31 square foot <br />variance for sign located in residential area. Violation of Ord. 87-93, <br />Sections 1163.06-(a)1 and 1163.05-(a). <br />Chairman Bugala called all interested parties before the Board. The oath was <br />administered to Mr. Patel, representing Day's Inn, and Mr. Clingman, owner of <br />the land on which the sign is to be placed. Since Mr. Bugala had had difficulty <br />finding the sign location, Mr. Patel presented a map and explained that this, <br />was a directional sign right at the interchange, rir. Gomersall stated that he <br />is opposed to this type of sign in a residential area. Mr. Grace pointed out <br />that the Board has not allowed them previously and all the other motels would <br />request them. R. Gomersall moved to grant the request for a variance to place <br />a sign on the property other than where the business is located and a 31 square <br />foot variance for a sign located- in a residential area to Day's Inn, sign loca- <br />tion at I-480 interchange on the west side of Clague Road, seconded by J. Helon. <br />Roll call on motion: Gomersall, Helon, Grace, Restifo, and Bugala, no. Motion <br />failed to pass. Variance denied.
