The City does have a concern about damage to Canterbury Road which <br />has recently been repaired, since it will not stand up under tri-axle trucks, <br />concrete trucks, ete. The developer does ha.ve the right.to use the road, but he <br />would have to restore it to its original condition, or else find an alternative <br />route.. This must be addressed by.the developer. The Commission took a five minute <br />recessed at this time. When the meeting resinned, Trir. Gorris recapped that there is <br />concern about the square footage of the triplex tmits, and that Mra Skoulis is <br />concerned about safety which was addressed by Mr. Conway who advised that these <br />un;ts would meet State eodes. Mr. Skoulis responded that it goes beyond that, he <br />pointed out that the Commission wrote a code and now with the first proposal, they <br />are considering changes. Mr. Gorris stated that Mr. Hi11 had explained that, when <br />the codes were drawn up, they -had not anticipated this type of building and <br />considering that they ha.ve never had a district like this before they merely <br />overlooked something. Mr. Skoulis preferred to change the code rather than make <br />these concessions. Mr. Dubelko clarified that the Commission did have the <br />flexibility to recommend to Council that there be a variation to the code. Mr. <br />Skoulis is not willing to accept the triplex concept at all, since it looks more <br />like an apartment or multi-family unit. He does like this concept, but he is not <br />willing to make major changes to the code, and suggested that the Comrission meet <br />with Mr. Bower to come to an agreement. Mr. Orlowski agreed stating that he liked <br />the Golf Homes, but the Vista Hone section appears to be a packing-in of living <br />un;ts, and the stacking concept is not compatible with the eluster home concept. <br />Mr. Skoulis questioned why, since the Golf Home area had side by side units, the <br />developer stated he cannot do that in the Vista Home area. I4r. Bower stated that <br />the density was necessary in this area which is so close to I-480 and the Butternut <br />Ridge-Canterbury Road intersection, and there axe price differences in the two <br />village a-reas, and that a triplex building is allowed in the code. iMr. Orlowski <br />clarified that these mist be attaehed by a conmon wall. PlJr. Bower responded that <br />the code allows the Commission the latitude to recommend approval of variations to <br />Council. Chairman Gorris pointed out that two members wanted the Golf style homes <br />in the Vi,sta Horne area. ?Mr. Skoulis reiterated that this is a major change to the <br />code, but if it the Building Gomissioner had no problems with the design, and this <br />was addressed by the code, he would have no problem with it at a11. He woul:d like <br />to meet with the developer to see if it would be possible to do something similar <br />to the Golf Homes, but he still believed that another entrance should be added to <br />the upstairs uni.ts. It was clarified that even though there are two doors, there is <br />only one conmon stairway. `Mr. Skoulis stated that he would like to make a motion <br />table this proposal tonight tmtil there is time to get together with Mr. Bower to <br />discuss the financial reasons as to why he came up with this particular concept and <br />cannot come up tsi.th another concept and to see whether or not there are some <br />alternatives that we can come up with that tnight make this thing fly, since Mr. <br />Bower does not want to discusa, his finances in an open meeting. Mr. Morgan pointed <br />out that it would have to be in an open meeting, because the Conmuission is governed <br />by the Sunshine Laws. Mr. Bower gave a brief stnrunary of the financial <br />consideration: they purchased 70 acres of land on which they could construct 225 <br />homes with a base price of $200,000.00 for a gross sale of approximately 45 million <br />dollars. The average sale price of the 156 Vista Homes would be $100,000.00 which <br />would be about 15 million dollars. The 110 golf homes, with an average price of <br />$165,000.00 that would add up to approximately 17 to 18 million dollars. The two <br />conbined would be about 32 million dollars. He maintained that they could not <br />reduce the Vista Homes to 75 and still make a profit. He again pointed out that <br />they would be making a bigger profit, if they constructed a single family <br />development, but the intent was to preserve the golf course. Mr. Skoulis maintained <br />that there are other alternatives, such as two or three side by side buildings <br />which would conform to the code. PZr.
