<br />to grant the request for a 4 foot location variance from the rear property line <br />for a tool shed for Mr. Clayton W. Hauck, 3105 West 231 Street, seconded by B. <br />Grace, and tmanimously approved. Variance granted. <br />4. Office Warehouse, 4706 Great Northern Blvd. <br />Request for variance (1123.12). Request 24 foot variance for encroachment of <br />loading dock in 50 foot rear setback. Violation of Ord. 87-93, Section 1139.05. <br />Also request variance for 10 parking spaces. Violation of Orde 87- 93, Section <br />1161.05(s). Also developer would like a variance for 72 parking spaces for <br />future conditions if ever needed. <br />This proposal will be returned to Planning Commission April 23, 1991. <br />Chairman Gomersall called a]1 interested parties before the Board. The oath was <br />administered to Mr. Mongello, architect, Mr. McKee, representing the owner of <br />the shopping center, and neighbor, Ms. Blagg. Other neighbors, Mrs. Weaver and <br />Mr. Pfaff, were sworn in separately during the meeting. Mr. Mongello explained <br />that the hydraulic truck dock is being removed and the new truck well will <br />extend 24.5 feet into the rear setback. Ms. Blagg is not concerned about this, <br />only about the parking variance, pointing out they are in violation of the <br />parking codes at present. Building Commissioner Conway explained that they are <br />17 spaces short now, but with the new occupancy they would have more spaces <br />than they need, however they must remove spaces for access to loading dock. Mr. <br />Grace believed that the dock was necessary because trucks frequently unload in <br />the front; but because the lot is so crowded, he suggested that they remove <br />only the parking spaces that are necessary. The neighbors presented a document <br />at this time stating their objections. Mrs. Blagg advised that a variance ha,d <br />been granted for the theatre on the basis that the parking would be at <br />different times than the other businesses, but the store that took its place <br />has the same hours - as the others do. Mr. Conway explained that the parking <br />required for the appliance store is far less than for a theatre, and again <br />stated that Office Warehouse requires even less parking and they only need a <br />variance because they are eliminating spaces for the dock and its access. <br />Neighbors have complaints about trash blowing onto their property, deliveries <br />and trash pick in the early hours when it is not allowed (dumpsters were <br />emptied at 6:00 a.m. this morning). The neighbors suggested that one garbage <br />company be used for the entire center, elinLinating some of the noise. Mr. McKee <br />stated that they are trying to get the tenants to agree to a centralized <br />dtmipster or compactor to reduce the rnanber of pick ups. Mr. Mongello stated <br />that when the owner tried to meet with the neighbors, they only received two <br />responses. Mrs. Blagg and Mrs. Weaver believed that a few neighbors had <br />responded,,but no meeting was ever set. The neighbors agreed that Mr. McKee did <br />clean up the property frequently, and it was the tenants who left the dumpsters <br />open. Mr. Grace suggested that the City cite these tenants. Regarding the <br />request for 72 spaces, Mr. Mongello stated that the owners do not intend to <br />build more on the property, they want those spaces in case there is a change of <br />occupancy in the future which would require more spaces. Mr. Grace suggested <br />that they re-strip the lot with the smaller sizes that are proposed in the new <br />code. Mr. Mongello responded that the owners do not want the smaller spaces. <br />Law Director Gareau advised that if they need a variance in the future they <br />return at that time. Mr. Mongello withdrew the request for the 72 parking <br />spaces. B. Grace moved to.approve the request of Office Warehouse, 4706 Great <br />Northern Blvd. for a 24 foot encroachment of loading dock in 50 foot rear <br />setback and to grant the variance for 10 parking spaces, seconded by T. <br />Restifo. Roll Call on motion: Grace and Maloney, yes. Restifo, Gallagher, and <br />Gomersall, no. Motion failed to pass. Variances denied. - <br />2
