Mr. Tallon suggested that the commercial owners could <br />be notified now and then again shortly before unless this is cost prohibitive. <br />Mr. Thomas suggested that perhaps the Illuminating Company could put some kind of <br />notice in their bills. B. Gorris moved to approve Ordinance number 92-102 and <br />Ordinance riumber 92-1031 seconded by K. 0'Rourke, and imanimously approved. <br />The members discussed two minor changes: the 01ive Garden is requesting to <br />enclose an area to store bread racks; and North Olmsted Home Care is requesting a <br />shed 40 feet behind theix addition. It was decided that there were no problems <br />with these requests and they could be handled by the Building Department. <br />In regard to the rough draft of the Master Plan which has been distributed to <br />the members, Mr. Thomas is concerned since some of the recommended rezoning on <br />the west end of the city would appear to be spot zoning. Mr. Tallon agreed that <br />the entire area was to be rezoned to Mixed Use "D", and the map only shows 3 <br />parcels rezoned to that classification. The members decided to discuss the plan <br />without County Planning at the next meeting, November 10th at 7:00 and formulate <br />questions which will be discussed with CPC later. <br />Chairman Gorris asked the Law Department to review the August 11, 1992 letter to <br />Mayor Boyle from the Ohio Department of Transportation regarding the access <br />drives onto Great Northern Boulevard from the Developers Diversified property for <br />compliance to the journal entry. City Engineer Deichmarm advised that the <br />Butternut Ridge Apartment drive is being corrected so that it conforms to the <br />agreement between O.D.O.T. and Developers Diversified, and O.D.O.T. has consented <br />to the Moen driveway. <br />Mra Gorris expressed his regrets that Mr. Bowen is resigning from the Commission <br />and thanked him for his service. <br />In reference to Nightfall, Assistant Law Director Dubelko stated tha.t a resident <br />has advised him that there have been noise problems with the new owners and there <br />is some debris an the property. He has been contacted by the new owners' attorney <br />who indicated this issue might have to be settled in court. He is believed that <br />the courts might allow them to pave the property as ordered originally as long as <br />there was assurance that the codes would be followed for the buffering. Mr. <br />Tallon received a call from one of the owners of the business who assured him <br />that if there were any problems he would handle them inunediately. Mr. Thomas <br />believed that the adjacent residents should be notified that there are going to <br />be changes. Mr. Tallon stated that the major concern was just that they would <br />pave the lot without installing the landscaping. It was suggested that some kind <br />of performance bond could be required. <br />IX. ADJOURNMIIQT: <br />B. Gorris moved to excuse the absence of L. Orlowski,'seconded by R.
