<br />Chairman Gomersall called a11 interested parties before the Board. The oath was <br />administered to Ms. Plummer, owner, and Mr. Smi.th, contractor. This variance is <br />needed Because the building is 250 fQet away from i,he Police Station parking lot. <br />The building where the bar is located now is to be raised. Law Director Gareau <br />advised that the Board of Liquor Control gaid absoZutely no attention to this 500 <br />foot rule which is a local law, but the State has to issue the liquor license. He <br />further pointed out that the Partner's present location is closer than this to <br />North Olmsted Park. Mrs. Flummer mentioned other establishments in the area which <br />are closer than they are. B. Grace moved to grant the request for a variance for <br />an establishment selling liquor to be 250 feet away from the lot of a public <br />building (500 feet required), seconded by J. rlaloney, and tman.i_mously approved. <br />Variance granted. <br />15.. Thoma.s and Sue Demi.s 5354 Devon Drive. <br />Request for variance (1123.12). Request 4 foot variance for location of shed from <br />rear property line. Violation of Ord. 90-125, Section 1135.02(d)(4). <br />Building permit issued for conforming location. <br />Chairman Gomersall called all interested parties before the Board. The oath was <br />administered to Mrs. Demis who explained that after they received a permit, they <br />discovered that the shed could not be iristalled where specified since it would be <br />partially in an area which was 8 inches lower because there had been a pool <br />there. They went ahead with the installation because they had people to help them <br />that weekend. She presented a statement signed by the neighbors stating there was <br />no objection. W.. Purper moved to grant the request of Thomas and Sue Demis, 5354 <br />Devon Drive, for a 4 foot variance for location of shed froM rear property line, <br />seconded by R. Gomersall, and unanimously approved. Variance granted. <br />16. Butternut RidRe Apartments, 5800 Great Northern Blvd. <br />Request for variance (1123.,12)o Request variance to install temporary 30 square <br />foot banner on club house building. Violation of Ord. 90-125, Section 1163.07. <br />Chairman Gomersall called a1.1 interested parties before the Board. The oath was <br />administered to Mr. and Mrs. Cooley, neighbors, T1s. Henley, sign contractor, Mso <br />Neubatun and Mr. Perry of Butternut Ridge Apartmentso Ms. Henley presented a site <br />plan and explained the reqtzest to install a 3 foot by 10 foot banner on the club <br />house facing Great Northern or else one or two banners on both sides of the <br />gates. Since many people think these apartments are for sale, they would like <br />the signs to state "Now Lea.sing". Mrs. Cooley objected to the request because, <br />not only are these apartnnents in a residential area, but an historical district. <br />There are signs on the site and advertiseznents in the newspapers. She questioned <br />the need for more signs, and maintained that they can see these signs from their <br />windows. Mr. and Mrs. Cooley pointed out where they lived and the riembers doubted <br />that these signs would be visible froM their propeY•ty. Mr. Cooley stated that <br />there are signs stating.that this is an apartment; there is a"Now Leasing" sign <br />on the corner; and questioned zahy bigger signs are needed to say the sarie thing. <br />He reminded the Board that this was not part of the mall. Building Conunissioner <br />Conway advised that there is one "Now Leasing" sign which they are permitted by <br />code, and they did instal]_ some other signs which were ordered removed. Ms. <br />Henley suggested that if the banners were not acceptable, another alternative <br />mi.ght be one 3 by 3 foot aluminum or wood, double faced sign at the front <br />entrance which would match the permanent signs. Mr. Conway was concerned about <br />obscuring the sight line at the driveway. Mr. Grace suggested one banner on the <br />fence, not two as proposed. Mr. Gomersall wanted a one year limit on it. Ms. <br />Henley agreed to amend the request for one 3 by 10 foot sign to be located on the <br />north side of the entrance, Mr. Cooley again objected because it could be seen <br />6
