Y ,...,s <br />Chairman Gomersall called a11 interested parties before the Board. The oath was <br />administered to W. Giesser, attorney, and Mr. Kula, representing the owner. Mr. <br />Giesser stated that they are planning to move the truck lot which is now on the <br />other side of Lorain Road to the property where Partners Lounge is located. The <br />request is to maintain the same setback that is on the adjacent car lot. Mr. <br />Gomersall explained that he is opposed to parking vehicles up to the sidewalk as <br />it is on the other lot, and he is also opposed to moving the. pole sign since <br />these signs are to be eliminated eventually. Mr. Giesser was aware that pole <br />signs were to be removed by 1998. Mr. Gomersall advised that a 75 foot setback <br />might be excessive, but tliere should be some setback, perhaps 20 feet. Mr. <br />Giesser stated that a 75 foot.setback would use up the entire area, and suggested <br />that the Board consider the consistency of the two setbacks. Mr. Gomersall <br />responded that if he had a choice, he would require a setback on the existing <br />lot, but it was "grandfathered" in. Mr.. Giesser lmew the City's policy NTith new <br />dealerships, but believed that this is a different situation since there is an <br />adjacent lot< He does not kn.ow what the plans are for the existing truck lot, but <br />the Partners' building will not be demolished. Mr. Grace agreed that 75 feet was <br />too much, but was opposed to parking up to the sidewalk. Law Director Gareau also <br />believed that 75 feet was excessive and mentioned that the Lexus Dealership was <br />offered the option to display new vehicles within the setback provided some <br />vehicles were displayed on pads within a landscaped area; they decided.not to. <br />The Oldsmobile Dealership was the first to do this with one or two vehicles <br />displayed in a landscaped area and the others beyond a 35 to 50 foot setback. <br />This might be a problem because the building on the property is about 35 feet <br />from the right of way and would hamper any improvement to the area. Mr. Grace and <br />Mr. Purper would like some kind of a compromise. Building Commissioner Conway <br />advised that 20 feet is thp minirmum landscape bu.ffer required before a parking <br />lot.(customer parking). He further stated that if any improvements to the lot <br />were planned, they must be reviewed by the P1arLn;ng Commission. He advised Mr. <br />Giesser that, depending on what was to be done, putting in green area would <br />probably have to go to Planning Commission. Mr. Gomersall believed that <br />inStalling the green area would make room for a ground sign instead of having a <br />pole sign, and believed that this should be reviewed by the Commission. Mro Grace <br />does not want 25 trucks in a. row (mirror to mirror) even if it is 25 feet from <br />the street, and would like the pods behind the 25 foot set ba.ck. He pointed aut <br />that if the building were removed later the line of trucks would be continued to <br />the next property. Law Director Gareau agreed, advising that the variance would <br />nm with the lancl., not the building. Mr. Giesser asked that the request be <br />continued. B. Graee moved to continue the request for the Halleen Chevrolet <br />Truck Lot until next month, seconded by R. Gomersall, and unanimously approved. <br />Continued Lmtil April. <br />3. B. B. & C. Realty (Affordable Cars and Finance), 27724 Lorain Rd. <br />Request for variance (1123.12). Request variance to display vehicles for sale in <br />75 foot front setback. Violation of Ord. 90-125, Section 1139.07 (see table): <br />Also request variance for individual store signage on ground sign, request 1 foot <br />variance for location of gr•ound sign, and request 50 square foot variance for <br />total sign area allowed for a business imit. Violations of Ord. 90-125, Section <br />1163.12 (h) & (B) and 1163,11(c). <br />Mr. Giesser and Mr.Kula had been sworn in for the previous request. Mr. Giesser <br />explained that there is a 7 foot green area existing on this property and and <br />there had been a variance when this had previously been operated as a car <br />dealership. This variance is allegedly gone since the property has not been used <br />2
