CITY OF NORTH OLMSTED <br />BOARD OF ZOIVING APPEALS <br />MINUTES--MAY 6, 1992 <br />Chairman Gomersall called the meeting to order at 7:40 p.m. <br />Present: B. Grace, S. Ferencik, J. Ma.loney, W. Purper, and R. Gomersall. <br />Also Present: Law Director Gareau, Chief Building Inspector Sanker, and Clerk of <br />Commissions Oring. <br />B. Grace moved to approve the minutes of April 1, 1992, seconded by R. Gomersall, <br />and unanimously approved. <br />Chairman Gomersall advised that there were 16 cases and a special permit. He <br />explained that Board members had viewed the premises in each case, each case will <br />be judge on the physical situation peculiax to itself, and no judgement is to be <br />considered to be a general policy judgement affecting properties or like <br />situations elsewhere. It will take 3 affirmative votes to approve a request. <br />Chairman Gomersall advised that the first two requests, Ha.lleen Chevrolet and <br />Affordable Cars, would be._heard at the end of the agenda. <br />1. Keith and Aline McCormick, 26760 Hyannis Port Drive <br />Request for variance (1123.12). Request 10 foot (average) rear yard variance to <br />construct anaddition. Violation of Ord. 90-125, Section 1135.08(b). <br />Chairman Gomersall called all interested parties before the Boarda The oath was <br />administered to Mr. Tufts, architect. A]1 members had viewed the premises and had <br />no comments on the proposal. B. Grace moved to grant to Keith and Aline 26760 <br />Hyannis Port Drive, the 'request for a 10 foot (average) rear yard vaxiance to <br />construct an ad.dition, seconded by J. Maloney, and imaiimously approved. <br />Variance granted. <br />2. James A. Miller, S/L 300, Porter Road,_located between 5938 and 5918 Porter Road. <br />Request for variance (1123.12). Request 300 squaxe foot variance for area of <br />dwelling. Violation of Ord.90-125, Section 1135.03(b). Also request 17 foot rear <br />yard variance. Violation of Ord. 90-125, Section 1135.08(a). <br />Proposal was heard by boaxd of Building Code Appeals on February 27 and March 26, <br />1992. Continued tmtil variances granted and Engineering approval. <br />Chairman Gomersall called all interested parties before the Board. The oath was <br />administered to R. Miller, J. Miller, Councilman Nashar, and to neighbors, J. <br />Jewett, Mr. & Mrs. Eichelberger, Mr. and Mrs. Hosier, Ms. Ginn, and Mr. and Mrs. <br />Gravenstreter. Mr. Gomersall asked that the neighbors speak ane at a time and not <br />repeat statements ma.de by others. R. Miller explained the, proposal to build a <br />1,000 square foot ranch. Previously they had requested a colonial home on the <br />same lot and it was denied because it was too high. This 40 foot lot was plated <br />in 1892. He maintained that this home will conform to the neighborhood; it will <br />increase taxes, and get rid of an abandoned lot. It would be impossible to build <br />on this lot without variances. Mr. Gomersall stated that this request was not <br />denied because the house was too high, it was denied because of drainage <br />problems. Mr. Miller stated that the drainage problem ha.s been taken care of. Mr. <br />Nashar pointed out that this request had been denied by this Board four times; <br />that this property was originally grandfathered in, but once the lot was sold the <br />grandfather status is null and void; there is still a drainage problem on the <br />street; the lots on either side are 60 foot lots; and this lot was cLivided out <br />1
