CITY OF NORTH OLMSTED <br />BOARD OF BUILDING CODE APPEALS <br />MINUTES-JANiTARY 28, 1993 <br />I. ROLL CALL: <br />Chairman Burk called the meeting to order at 7:32 p.m. <br />Present: J. Kazak, W. Piar, D. Spoerke, and R. Burk. <br />Absent: B. Schulz. <br />Also present: Building Commissioner Conway,.Building Inspector Kettle, and <br />Clerk of Commissions Oring. -;? <br />II. REVIEW AND CORRECTION OF MINUTES: <br />J. Kazak moved to approve the minutes of July 30, 1992 as typed, seconded by <br />D. Spoerke, and unanimously approved. -" " <br />III. COMMUNICATIONS: <br />No items. <br />N. HEARINGS: <br />1) Raymond N. and Plaseda A. Chappell, 31441 Lorain Road. <br />Determinatiori that this structure at 31441 Lorain Road meets the definition <br />of a dangerous and Unsafe building as specified in Chapter 1331 of the North <br />Olmsted Building Code and requires demolition. <br />The oa.th was administered to Mrs. Wagner, the former owner of the property, <br />and her son J. Wagner. Mr. and Mrs. Chappell were not in attendance. Other <br />neighbors arrived later. The members had received letters and statements. <br />pertaining to the structure. An inspection dated April 2, 1992, from Mr. <br />Kettle, the Building Inspector, documenting the violations existing in the <br />structure and concluding that the property had been 50% deteriorated from its <br />original value. An April 16th letter from the Building Commissioner to Mr. <br />Chappell, owner, advising him that the conditions would meet the definition of <br />a dangerous and unsafe building and necessary steps to declare the building an <br />unsafe structure would start the week.of April 27th. Letter on July 7, 1992 <br />advised that the building ha.s now become vacant and is a clangerous, and Unsafe. <br />building and requesting the owner contact the Building Department iirnnediately <br />advising when he intended to raze the structure as originally promised. This <br />letter further stated tha.t if no answer is received within 7 days, condemnation <br />proceedings would be started. A memo of December 16th requesting that.the <br />members of the Board of Building Code Appeals meet on the site on?January:}6th. <br />There was a note in the file from the Sheriff's office that the-property'was in <br />foreclosure and it would be 6 weeks before action would be taken. Mr. Conway <br />advised that a11 parties had been notified of this meeting. Mr. Burk stated <br />that on January 6th the members had observed all the conditions tha.t were noted <br />in Mr. Kettle's stateanent. Mr. Conway advised that there was a November 16, <br />1992 letter missing from the file in which he had advised Mr. Chappell of Mr. <br />Kettle's report and had given the. owner imtil December 16th to appeal to this <br />order, but no appeal has been filed. Mr. Burk reviewed Chapter 1331 of the <br />North Olmsted Building Code listing the defects which would make a building <br />dangerous. Mr. Kazak read Mr. Kettles report which indicated the section <br />numbers of the items which were found to be in disrepair. Mr. Conway advised <br />that there were about 6 items found which would define the building as an <br />1
