<br />the Architectural Review Board, he have dimensions on his plans showing the <br />diriensions of the footprint of the building, the canopy; the lot itself, as well <br />as dimensions of the driveways, the width and length; to indicate where any <br />existing grassy areas are or where. landscaping is to be located including all <br />dimensions for those; also to show where any new parking or striping on the lot <br />will be located, any directional arrows etc.; and at the same time the Commission <br />would like the Architectural Review Board to determine an appropriate landscaping <br />plan for this development and to make suggestions to the developer for improving <br />the site with additional landscaping, also that the developer submit a new sign <br />with tha.t plan complying with the city's current code. The Commission would also <br />like to refer this to tixe Safety Department, Police and Fire, particularly <br />request the safety forces to determine whether or not these driveways are <br />appropriately loeated and if some alteration of the driveways in relation to <br />Lorain and Columbia Road should be made. To request the Safety Department to <br />determine what can be done with signage that would allow freer exiting from this <br />property, perhaps by stopping traffic further east on Lorain Road and further <br />north on Coltunbia Road so that it would.leave those driveways open for ingress or <br />egress. To refer to Engineering for appropriate drainage and compliance with the <br />city code for retention, and also to look at the driveways for any configuration. <br />that would be more appropriate. That the develo;per provide a more accurate <br />rendering of the canopy to eliminate any signage on the canopy unless it complies <br />with code, seconded by A. Skoulis, and unanimously approved. <br />IV. NEW DEVELOPMIIVTS AND SUBDIVISIONS: <br />1) Cleveland Electric Illuminating Company Assembly and Lot Sp1it Plat, <br />Resubmission. <br />The proposal is to combine and re-subdivide all or part of Permanent Parcel Nos. <br />237-5-1, 237-5-3, 237-5-23 and 237=7-18 i.nto two (2) parcels. This revised <br />proposal was originally reviewed by PlarLn;ng Commission an January 12, 1993. <br />Mr. Beursken, who represented Genterior Energy, explained that the new plat noW <br />conforms to code and shows where the buildings are located an both parcels. He <br />had submitted a copy of the lease to Assistant Law Director Dubelko in order for <br />him to draw up a restrictive covenant on the one lot. Mro Thomas read a letter <br />submitted by Mr. Dubelko and noted some problems: he received an unsigned copy of <br />the lease/option agreement between C.E.I. and United Survey on the 22nd; since <br />United Survey is apparently purchasing the property, he believed that they should <br />be made officially aware of and consent to any condition imposed if the assembly <br />is granted; and further, he does not believe that the city is under any <br />obligation to approve this proposal because it violates provision of the city's <br />zoning code and creates a new problem in that the city must protect the <br />neighborhood near this property. He concluded that the best solution would be to <br />rezone the new lot or at least reqvire all of the interested parties to impose, <br />by deed, restriction upon the use of the property. No restrictive covenant ha.s <br />been dxaw up as yet, but would be prior to the next Planning Commission meeting. <br />Mr. Thomas believed that this could not be acted upon until a copy of the <br />restrictive covenant is available for revie«. Vice Chairman Orlowski preferred <br />that the property be rezoned, and if that is done United SUrvey could continue to <br />use it as a non-conforming use. Mr. Beursken was given a copy of Mr. Dubelko's <br />letter. J. Thoma.s moved to table the Cleveland Electric Illtuninating Company <br />Assembly and Lot Split Plat, Resubmission, seconded by K. 0'Rourke, and <br />unanimously approved. <br />., <br />2) Barton Oaks Subdivision, Pre.liminary.Plan. <br />The proposal is to subdivide Permanent Parcel Nos. 233-3-2, 233-3-4, and <br />233-3-10, located on the north side of Barton Road near the Lorain county Line, <br />?
