4 <br />recommendations. Mr. Gorris doubted that Council would adopt the recommendations <br />in their entirety. Mr. Dubelko agreed, Council approved it to get it on the <br />books, and then as the rezoning comes before them, they will study the <br />feasibility of rezoning each area separately. Councilman Lind stated that when <br />the plan was accepted, the council was not speeifically approving it totally; the <br />thought was that they would debate the specific areas when the legislation came <br />before them. He believe that every council person ha.d portions of the plan that <br />he was not comfortable with. He agreed with Mr. Skoulis that basically they were <br />looking at this as a list of recommendations. Mr. Skoulis wondered if the Ma.yor <br />would be appointing someone to make sure it was implemented. Mr. Gorris believed <br />that it was the Commission's job to see to it that it gets done, especially since <br />the members had spent 3 years doing it. If Council does not approve certain <br />portions of the plan, at least they can give a reasonable explanation as to what <br />they do not like, and that would be Council's prerogative since they are the <br />elected officials. 'Ihe worst thing that could happen was that nothing gets done, <br />the plan just collects dust. If the legislation is presented, and the Council <br />does not approve of certain portions, at least they have been given the <br />opportunity to discuss it. Mr. Orlowski asked that if Council does not agree with <br />a recommendation, could the Commgssion request in the legislation that they look <br />at an alternative so that something takes place. Mr. Gorris stated that if the <br />legislation dies in committee, it would be up to the Commission to revive it <br />since, even though Council has a right to disapprove it, the Commission should be <br />entitled to an explanation. Mr. Dubelko clarified that the Planning Comnission <br />can present the legislation directly, a Councilperson does not have to introduce <br />it. Mr. Skoulis would like to also consider the portion of the plan that suggests <br />beautifying the city, by giving low interest loans, etc. Mr. Tallon stated that <br />some of these programs are in place right now. Mr. Dubelko stated that some of <br />those ideas would have to be addressed by changing the zoning codes. In reference '- <br />to where to start, Mr. Skoulis noted that 'Stearns Road construction has been <br />delayed and this area would not have to be addressed imediately. Changing the <br />zoning codes to implement the plan should be addressed after the rezoning <br />legislation has been presented. In order to draw up the legislation, Mr. Dubelko <br />can check the zoning in the Master Plan, but he would ha.ve to get the <br />descriptions of the parcels fron the Engineering Department and he would probably <br />attach a map to the ordinance as well as identifying them by parcel rnunbers. Mr. <br />Gorris stated that it would be up to the La,w Department to consider if the land <br />adjacent to these parcels should be rezoned as well. Mr. Dubelko noted that the <br />use of any land that has already been developed would be grandfathered in. The <br />members agreed that legislation for the rezoning of the Sherwin Williams property <br />should be started now in the event that Wal-Mart does not go through on those <br />parcels. Mr. Dubelko stated that rezoning this could not be construed as spot <br />zoning since this is a critical intersection and this might help in the event <br />that Wal-Mart did withdraw since the property could be developed for another <br />similar type use. He clarified that if a developer filed an .appli.cation for a <br />building permit before a property is rezoned that zoning classification would <br />remain for that proposal. Since the Crocker Stearns Road has been delayed, it was <br />decided that this could be left until later. Mr. Tallon advised that the sound barrier requested by the residents has been included in the plans for the <br />northern segment of Crocker/Stearns Road and the construction is targeted for <br />1997. The members discussed the plan among themselves. Mr. Dubelko will get some <br />data from the Engineering Department and then will present the legislation for <br />the members approval. Regarding the Cluster Home requirements, Mr. Skoulis is <br />proposing that it should be stipulated that in the code that there can be no more <br />than 6 homes per acre of the land to be developed for homes.
