It was clarified that the vehicles would be <br />displayed behind the front landscape buffer and now that the Partner's lot is <br />included, the proposal is different than what was originally presented. These two <br />lots must be assembled. In reference to the assembly, Mr. Giesser stated that the <br />Commission had approved the assembly with a covenant restricting the <br />residentially zoned property in the rear.which is not part of the parcel tha,t is <br />to be joined, it is part of the original parcel, and they are not willing to <br />accept the covenant for the back parcel. He explained that they had no idea of <br />what might happen in the future, and they do not want to restrict its use to <br />residential. Mr. Tallon stated that originally this residential property was <br />intended to be used as a buffer forever and this tiras stated in the minutes in the <br />early seventies. Mr. Giesser did not remember this. Mr. Tallan stated that when <br />the property was split, it was agreed that this lot would remain as a buffer. Mr. <br />Halleen stated that this happened before he bought the property from B. B. and C. <br />Realty. Since this residential portion is paxt of the original lot, Mr. Dubelko <br />stated that he has consistently advised that when there is a split zoned lot, <br />either there be a rezoning or that a restrictive covenant be included. It would <br />be up to the Comnission to either continue this restriction or reconsider it. It <br />was clarified that the Partner's lot is not split zoned, just the original lot. <br />The members agreed that the covenant was still needed, and noted that this area <br />ha.s been a green area ever since the car lot was in existence. Mr. Dubelko stated <br />that the assembly is a separate issue which is not before the Comnission at this <br />time and this can be approved separately. R. Tallon moved that the proposal to <br />renovate building and to_ construct two small additions for Halleen Chevrolet, <br />Inc., 27932 Lorain Road, be approved with all the recommendations of the Board of <br />Zoning Appeals, Planning Commission and the Architectural Review Board be <br />included with the 'inclusion that Mr. Halleen has agreed to change the round <br />lighting fixtures on the property at 27832 Lorain Road to the Spaulding Lighting <br />Company, Cordova, CV3 lighting fixture, and that the landscaping on the eastern <br />side of the landscape buffer is to be 20 feet, but is not shown on the plan, <br />seconded by L. Orlowski, and tmaninously approved. During the motion Mr. Conway <br />brought up the point that there was no dimension on the eastern portion of the <br />new landscape buffer and that it did not scale out to a full 20 feet. This was <br />then included in the motion. The clerk will look up the minutes pertaining to the <br />first assembly of the Halleen property in which it was agreed to keep the <br />residential property as a buffer. <br />N. NEW DEVELOPMIIVTS AND SUBDIVISIONS: <br />1) Hennie Homes: Block "A" Lot Split. <br />The proposal is to split Block "A" of the recorded (volume 262 page 50) Cinnamon <br />Woods Dedication Plat into three (3) residential lots. Location is the west side <br />of Barton Road abutting Olmsted T.ownship at the North Olmsted south corporate <br />line, and abutting the east property line of Cinnamon Woods Development. Note <br />that current zoning is Mixed Use entirely, and adjacent to "A" Residence, Single <br />on the north, and to "B" Residence, Single, directly across Barton Road on the <br />east. Two of the three proposed sublots conform to "B" Residence requirements for <br />frontage and area, while proposed Parcel 3 has less than the required frontage <br />for a"B" Residence Zone. The proposal does not include a rezoning request. <br />Tabled from Planning Conmnission meeting of September 28, 1993. <br />Mr. Grendell, attorney, presented pictures of the properties an the west side of <br />Barton Road starting in Olmsted Township with the property adjacent to the Hennie <br />Homes property facing Barton Road and going north.
