Mr. Schuler stated that her question was still not answered. <br />Mr. Gorris clarified that everybody has a right to sue, if she believed that the <br />City was negligent, but r1r. Dubelko could not pass on the merits of the case. She <br />begged that the Commission try to stop them. Ever since 1983 they expected the <br />Corporate Center and the theater. They do not want the increase in crime. She <br />mentioned that Wal-Mart wanted to go into Westlake, but they stopped them. Mr. <br />Gorris responded that the property they wanted was not zoned properly for that <br />use. The Commission would not rezone for retail use, but they will try to <br />mitigate the negative effects on the adjacent property owners. He agreed that it <br />would add to the traffic problem, but they were told that they cannot address the <br />traffic. Mr. Deichmann clarified that 10,000 trips equaled 5,000 cars, not 10,000 <br />cars. Mr. Dubelko stated that it is up to the city to have planned the proper <br />infrastructure to support the zoning. Regarding improvements to the <br />infrastructure, Mr. Deichmann stated that any improvements in the area were <br />looked at before Wal-Mart was proposed, Brookpark and Columbia will take place <br />whether Wal-Mart is built or not, but Council must authorize funding. Mrs. <br />Schuler also mentioned the crime, and safety of children since their playground <br />buts up to the Wal-Mart property. She also stated that they did not saant the <br />building beside them, if it has to be built they would prefer it near the <br />corporate center. It saas clarified for her that the condominiums were 26 feet <br />from the right of way on Brookpark, and that the right of way is in the grass <br />area. Mr. Thomas asked if she would rather have a parking lot in between the <br />building with 50 feet of buffering or would she prefer 100 feet of landscaped <br />buffer with fencing and mounding and then the building. She would like the <br />Cor.miission to meet with the residents because during the presentation they could <br />not see the plan.
