Mr. Papandreas advised <br />that they have been aware of the general location of the curb cut within a 100 <br />foot distance on either side, and the proposed curb cut is very close to that <br />location. Regarding the encroachment on the Corporate Center buffer on the south <br />by repositioning the building 10 feet to the west, Mr. Conway explained that the <br />25 foot landscape buffer between the Corporate Center's paxking and Wal-Mart must <br />be reduced by two to eight feet to accommodate their drives. Mr. Papandreas did <br />not see that as a problemo In response to Mr. Conway's question, Mr. Papandreas <br />advised that they are selling the land, but they do consider this project as part <br />of the Mixed Use development. Mr. Conway clarified that if this was all one <br />development, there would be no code problem and the buffer could be worked out <br />between the buyers and the sellers. Regarding the traffic study report, City <br />Engineer Deichmam advised that Mr. Griffith ha.d discussed it with Wal-Mart's <br />traffic consultant. Mr. Newberry will be supplied a copy of this report. Mr. <br />Griffith had raised several points. In reference to the ma.in entrance, he had no <br />problem with the locatian but it could be moved 200 feet either east or west <br />without disrupting the traffic flow on Brookpark Road which would give some <br />latitude if it were necessary to move the entrance. On Country Club Boulevard, <br />Mr. Griffith also mentioned that possibly a traffic signal would be required at <br />the far east Country Club drive accessing the east parking lot of the Corporate <br />Center. Mr. Gorris asked if Biskind Development or Wal-Mart would comnit to the <br />cost of the signa.l. Mr. Deichmam clarified that a signal was not warranted there <br />at present. Mr. Gorris thought triat it might be warranted amonth after Wal-Mart <br />opens up. Mr. Deichmam responded that it would not be warranted until the parcel <br />on the south side of Country Club was developed at which time a signal might be <br />warranted. Mr. Gorris then wondered who would pay for it when it is warranted. <br />Next, Mr. Griffith's report had stated that there should be no main drives in <br />front of the building, and Mr. Gorris would like Wal-Mart to study that, since it <br />might le better to move the main clrive 100 feet to the west and have a main drive <br />with parking on both sides, so it does not go directly in front of the building. <br />Further, he would like Mr. Griffith's opinion as to the need for signalization at <br />Country Club and Columbia with this development going in. Mr. Deichmam stated <br />that this would not be warranted at this time even with the construction of <br />Wal-Mart. Mr. Gorris would like to see this in writing. At this poi.nt, Councilman <br />McKay noted that Mro Griffith stated that the traffic study did not go far enough <br />east. Mr. Gorris pointed out that Mr. Griffith mentioned in his report that <br />Wal-Mart's traffic study stated that adjacent residences are located a fair <br />distance fran this site and will not be adversely effected. Mr. Griffith replied <br />"Item 7, on page 15, has no support data anywhere in this report, this is the <br />only place in this report where the residential areas east of the site are <br />mentioned, therefore how can this conclusion be drawn". Mr. Gorris would like Mr. <br />Griffith to clarify if he needs more information as it relates to the impact of <br />this development on the residents to the ea.st. In reference to the width of the <br />drive, Mr. Conway advised that this was corrected by the developer. In response <br />to Mr. Gorris questions, Mr. Dubelko advised that even though the Board of Zoning <br />Appeals had made suggestions requiring the type of buffering within the 60 foot <br />area, the Commission would not be bound by the suggestions made, and if the <br />variance was conditional on any buffering requirement, these can be considered as <br />minimums and the Commission would still retain its authority to make <br />recommendations as to what they believed to be necessary to buffer. In reference <br />to the members' questions „ Mr. Newberry advised that there are two cart storage <br />racks inside the building and 5 rart corrals in the parking lot for temporary <br />storage. As for outside display, Mr. Bingham explained that there were some <br />restrictions placed by the owner, but there is a potential for display along the <br />front sidewalk and some garden supplies in the south parking area. Since this <br />6
