10 <br />CITY OF NORTH OLMSTED <br />PLANIVING CONINBSSION <br />MINUTES-MARCH 29, 1994 <br />SPECIAL NIEETING <br />I. ROLL CALL: <br />Cha.irman Gorris called the meeting to order at 7:30 p.m. <br />Present: D. Alston, P. Miller, L. Orlowski, K. 0'Rourke, R. Tallon, J. Thomas, <br />and B. Gorris. <br />Also Present: Assistant Law Director Dubelko, City Engineer Deichmann, Building <br />Commissioner Conway and Clerk of Commissions Oring. <br />II. REVIEW AND CORRECTION OF MINUTES: <br />The minutes of the previous weeting were deferred until the next regular meeting. <br />III⢠BUILDING DEPARTMIIVT REQUESTS: <br />1) Wendy's Restaurant, 26650 Lorain Rd. <br />Proposal to construct small addition to restaurant and reconfigure parking area. <br />Tabled at the meeting of March 8, 1994. <br />Mr. Dixon, architect, explained that the plans have been revised to eliminate <br />the driveway closest to Lorain Road as requested by the Engineering Department, <br />because of this they were able to add 3 or 4 parking spaces and some landscaping. <br />They will be requesting variances for a 13 foot front setback variance, an 18 <br />foot side setback variance and an 8 foot rear setback. Landscaping has been added <br />along the side line and around the cooler as requested by the Comnission. They <br />also need a variance to put the pylon sign 5 feet from the right of way instead <br />of 10 as required. He explained that a ground sign can be 5 feet from the right <br />of way, but they needed the height of a pylon sign to get it above the cars so <br />that it would be visible. They have also submitted drawings for a board on board <br />dumpster enclosure as requested. City Engineer Deichmann believed that this <br />location was too close to the corner for a large sign, and would prefer more <br />sight distance. He would like it set back amin;Tr»um of 15 feet, preferably 20 <br />fran the curb. The code calls for 10 feet fran the right of way which is usually <br />1 foot inside the sidewalk. Mr. Dixon advised that the closest face of the sign <br />was approximately 16 feet from the curb. Mr. Deichmarm clarified that he would <br />prefer 20 feet, but 15 feet from the curb would be absolute min?rrnum, iZr. Orlowski <br />suggested moving the sign approximately two feet back even with the parking area <br />which would give 7 feet of open area in front of the sidewalk; this would be 18 <br />feet fran the curb. Mr. Dixon stated that the sign was located in the middle of <br />the pa.rking area so that there would be the least obstruction of either drive. He <br />explained that they needed the pylon sign which is narrower and taller. They are <br />requesting the variance to place it somewhat in-front of the cars it would be <br />seen more easily. In response to Mr. Thomas' question, Assistant Law Director <br />Dubelko explained that an applicant for an area variance must show a practical <br />difficulty, as opposed to a ha.rdship needed for use variances. This would have to <br />show a practical difficulty due to the configuration of the lot. Mr. Orlowski <br />requested that they remove the caricature of the girl from their signage. He <br />explained that, even though the Wendy's girl is not objectionable, others have <br />wanted caricatures which were. Mr. Dixon agreed. The city traffic engineer, L. <br />Griffith, had submitted a report suggesting that a sign be placed in the <br />landscape area next to parking space 24, directing traffic entering Wendy's from <br />Lorain Road to turn right rather than going into the drive-thru lane.
