?- ? <br />Ms. Rose, a representative of Mr. Peyalo, the owner, presented the proposal and explained that <br />the mural will take up about one third of the front wa1L She noted that there are 4 mural inside the <br />which were painted by an artist from Mexico. This one was a picture of Acapulco, and is an <br />invitation to come into the warmth of the restaurant. She has two letters, one from their neighbors <br />stating that they like the mural and believed that it adds to the building which was run down and <br />one from the owner stating that he would like to see the painting completed. This painting was <br />done by a local artist who had led the owners to believe that it would be all right to paint on the <br />outside of the building and it has been paid for. They specifically wanted a local artist who would <br />use more subtle colors than the Mexican artists used for the murals inside. The owners now live in <br />North Olmsted and are plauuing to improve the building. They do not consider this a sign and it <br />was done because this how buildings are decorated in Mexico. Mr. Gorris stated that he did not <br />disagree that this was attractive, however, he does not believe that murals should exempt from the <br />sign regulations, and he would prefer that the approval process be given by the Board of Zoning <br />Appeals. He stated that he was concerned that the next person might put up something that was <br />not attractive. Ms. Rose had been given to understand that they would have received an answer <br />from this committee. It was clarified that this would have had to go on to two other meetings, the <br />Architectural Review Board and Council. Mr. Orlowski explained that he did not find the mural <br />offensive, but was concerned about setting a precedent. He mentioned the developer of Wendy's <br />was asked to omit their girl from their sign., and he did not find the picture of the girl offensive. He <br />also noted that they are trying to cut down on signs along Lorain Road. Ms. Rose responded that <br />this was not a sign and if any neighbors or customers found it offensive, they would have come to <br />tonight's meeting. She asked if they would be allowed to cut out the mural and set it back a few <br />feet and put glass over it and call it a window. Building Commission Conway advised that this was <br />not the issue, it was here and it was on the wall. Mr. Orlowski stated that all the businesses in the <br />area want to call attention to themselves and they all want to be unique and stand out, and the <br />problem is that everything becomes a sign and the Commission has to draw a line somewhere. Mr. <br />Miller agreed that the owners have been very good about maintaining the building, and have an <br />outstanding reputation, but there are several issues here: what side of buildings would murals be <br />allowed on , which residences would have to look at them, and he is sure that someone would <br />come up with an offensive mural and there could be a problem in denying it. Mr. Gorris noted that <br />the Board of Zoning Appeals cau take each case on an individual basis, but this Commission <br />actions could set a precedent and they might have to approve something that they do not want. B. <br />Gorris inoved that the Nuevo Acapulco mural at 24409 Lorain Road could be constituted to be a <br />sign and as such any approval should come under the Board of Zoning Appeals , seconded by R. <br />Tallon, and unavunously approved. <br />IV. NEW DEVET,OPMENTS AND SUBDIVISION: <br />1) Root Road (p,ortion of ) Vacation Request. <br />The proposal, as requested by an abutting property owner (pennanent parcel no. 232-30-10), is to <br />vacate a portion (approximately 279.5 feet of Root Road not currently in use for roadway <br />purposes. Area Zoning is "A" Residence, Single (west side and `B" Residence, Single (east side) <br />of Root Road. <br />City Engineer Deichmaun explained that the section to be vacated is approximately 280 feet long <br />and there is an encroachment of a house and a shed the easterly portion of the area to be vacated <br />wluch would go to Mr. Clough, the property owner. The balance would go to the city since they <br />4 <br />.
