After som„ <br />discussion on the motion, J. Thomas moved to recommend to the B.Z.D. Committee of Council that they <br />grant Sycle Works a conditional use permit with a time limitation of one year, if the Law Department <br />advises that `'such a time limit cau be imposed, at which time they must return far a renewal, seconded by <br />B. Gorris, arid unanimously approved. <br />3) Andre LeBlanc, 30449 Lorain Road. <br />Proposal to keep mobile cappuccino unit on properiy. <br />Temporary variance granted by Board of Zoning Appeals August 4, 1994. - r z- <br />._ <br />Mr. LeBlanc, owner of the properiy, presented his request to keep the mobile cappuccino unif- on the <br />property for.-which a temporary variance was granted. Since that time he has improved the property by <br />installing a concrete slab in addition to the existing parking area. Building Commissioner Conway, advised <br />that he was allowed to pour the concrete only because he had excavated an area, which,he had <br />determined t'o be a sa£ety hazard. This was brought as a minar change before the board and they agreed <br />? <br />to allow it, liecause of safety. This is not au addition to the parking and is not used for parking of" storage. <br />Mr. Thomasconcluded theu that this parking would be illegal. Mr. LeBlanc asked if the members would <br />like to see a"video of a news program segment featdring this business. The members prefened not to see <br />it since it w,'as getting late. 1VIr. Miller stated that he had seen it. Mr. LeBlanc clarified for Mr. Conway <br />that he wanted to keep both the trailer and the hut on the property and that he would be using both units <br />as training aids and as retail outlets. He is the importer for the eastern United States for one brand of <br />expresso machine and a distributor for other types of machines. A person buying one of these expressi <br />machines needs training in order to operate it. Mr. Thomas noted that it was late and they were more <br />interested in` discussing the hut and mobile unit on the property. Mr. LeBlanc clarified that he wanted <br />both to do business out of these structures and would also be selling them. He explained that in the <br />northwest, many retailers converted Fotomates kiosks for this use and he would like to sell both the <br />expresso ma'chines and the kiosks from this properiy. In reference to Mr. LeBlanc's practice of waving <br />-to drivers, he disputed the fact that he waved drivers into his facility in the morning, he maintained that he <br />only waved "Good Morning" to passers by from the parking area. Mr. Thomas passed this everyday, and <br />_.believed that; stopping there was a traffic hazard. He is concerned about the appearance of the hut and <br />: could not see permitting tlus as a semi-permanent structure. He considered this to be an outdoor display <br />_?.which is addressed by the Zoning Code. Mr. Conway clarified that the structure would need a variance <br />-because it was encroaching in the 75 foot front setback. He further stated that the structure itself might <br />-;still need approval from the State of Ohio as an industrialized unit. This would be addressed later, if the <br />., .°.: Plauniug Coinmission and the Board of Zoning Appeals permitted it. At this point, he needs referral to <br />the Board of Zoning Appeals and providing the variances are granted, then Planuing Commission could <br />address the appearance. Tonight's discussion would only pertain to whether or not the Commission <br />wanted him in the 75 foot set back, and to review the parking, since tlus is an old parking lot and cars <br />must back out onto Lorain Road. He has added about 12 feet of depth, but the plan does not show how <br />cars can loop in and out. Mr. LeBlanc believed that the video would show that. Mrs. O'Rourke has seen <br />the video and is concerned about the traffic patterns since she has seen near accidents because of this. <br />She had no problem with the business, but that it is jeopardizing the safety of the children attending the <br />dancing school, the customers of Dairy King and drivers.using the adjacent roads in the area.. She notee <br />. that she had;two mother complain to her about it. Mr. LeBlanc responded that both the Diary King anc <br />dancing scho'ol are closed between 6:30 and 10 a.m, when he is open for business. He has been careful to <br />10
