?
suspended. Mr. Burk suggested that Mr. Simmons send Mr. Fox a certified letter stating what he
intends to do. Mr. Fox stated that he would be allowed in, but they could never come to an.
agreement as to how the work would be done. The members agreed that a permit could be issued
at this time since Mr. Simmons holds a license at this time. P. Engoglia moved that the matters
that was referred regarding Simmons Construction Company with respect to the revocation of the
registration, that the registration not be revoked at this time and that 30 days after notification of
a plan to correct the code violations has been submitted to the Building Commissioner, that those
code violations will be corrected, and in the event that the Building Commissioner finds that
Simmons Construction Conapany has attempted to make those code violation corrections and has
been prohibited from doing so, then that aspect of the revocation is to be dismissed, but that as
part of this whole process that Mr. Simmons is still placed under a six month probation, and it
during that six month period, and he is doing construction in the city of North Olmsted and if
there are code violations, and that he is notified of those code violations and they are not
corrected within 10 days, then the six month suspension or revocation of his registration will be
in effect for that period of time. It should be noted that Mr. Simmons has 7 days from today to
get the list of how the violations are to be corrected to Mr. Conway, and the 30 day time period
would start from the day of W. Conway's response. The motion was seconded by Mr. Burk, and
unanimously approved: During the discussion of Old Business, Mr. Fox returned to the board
and asked if he could submit a letter listing the other code violations that he had found. Mr.
Conway will review any other possible code violations that he lists.
VI. OLD BUSINESS: ;
Regard.ing the licensing of private home inspectors, Mr. Conway asked for a clarification from
Mr. Gareau that this board, under this board's authority to require registration of contractors, _
could require the registration of private home inspectors without out additional legislation. Mr.
Gareau doubted that it would, and suggested that Mr. Conway make a recommendation to city
council that the code be amended to provide for registration of private home inspectors, and that
it should be noted that:there were some certain minimum qualifications. Mr. Conway advised that
it had been decided that the board was going to make some suggestions to him as to what
miiuinum qualifications would be required. He again asked the members to send any suggestions
for qualifications to him so he could formulate a list of qualifications. Mr. Engoglia is acquainted
with a private home inspector, and he will try to get some information from him. Mr. Gareau
wondered how a buyer would know that the city licenses home inspectors and which ones were
licensed. Mr. Conway advised that he would notify the various real estate agents that registration
is required and make a list of registered inspectors available to them. He has also stated that the
real estate editor of the Plain I3ealer offered to print an article after the registration has been
instituted. The members explained what had been discussed previously on private home inspectors
to Mr. Gareau and Mr: Engoglia. .
VII. ADJOURNMENT:
The meetin was adjourned at 9:15 p.m.
R ur , Chainnasi B. Oring, erk of Commissions
8
