.L • '?= - CITY OF NORTH OLMSTED BOARD OF ZONING APPFATS MINUTES-APRIL 6, 1994 Chairman Gomersall called the meeting to order at 7:30 p.m. Present: T. Koberna, J. Maloney, and R. Gomersall. Ms. Boyle arrived later. Absent: W. Purper Also Present: Building Commissioner D. Conway and substitute Clerk of Commissions R. Wingenfeld. J. Maloney moved to approve the minutes of March 9. 1994, seconded by PZr. Koberna, and unanimously approved. Chairman Gomersall advised all present that, since there were only 3 members present and it would take 3 affirmative votes to approve a request, any applicant who wished to withdraw should do so at this time. He further advised that each of the board mer,ibers present had viewed the premises involved in each case. Each case would be judged on the physical situation peculiar to itself so that in no way is a judgement rendered considered to be a general policy judgement affecting properties and like situations elsewhere. 1. Elias Brothers Restaurants, Inc. 26700 Lorain Road. Request for variance (1123.12). Request 56.50 square foot variance for total sign area for a business use; request 39 square foot variance for free standing signs; and request variance to have a second free standing sign (one allowed). Violations of Ord. 90-125, Section 1163.11(a); and 1163.12(b)a Request denied 3/9/94, proposal is now based on removing the wall sign. Chairman Gomersall called all interested parties before the board. The oath was administered to Mr. Myles, Director of Operations for Big Boy. Mr. Gomersall stated that at the last meeting, the loard ha.d ruled that the Big Boy statue was a sign, and denied the variance, beeause the representative would not agree to removing any of the existing signage. Mr. Plyles explained that, since then they discussed this with the people at headquarters and it was decided that the wall sign, which is on the opposite side of the door from the statue, could be taken down. The members agreed that this would be satisfactory. J. Maloney moved to grant the request for Elias Brothers Restaurant, 26700 Lorain Road, for 39 square foot variance for total sign area for a business use and a an 89 square foot variance for free standing sio and a variance to have.a second free standing sign (one allowed), seconded by R. Gomersall, and unani.mously approved. Variance granted. 2. Raymond Thomas, 24001 Frank Street. Request for variance (1123.12). Request 3 foot side line variance to replace detached garage. Violation of Ord.90-135.02(c)(2). Chairman Gomersall called all interested parties before the board. The oath was admi.nistered to Mr. Thomas. Mr. Gomersall stated that all the members had viewed the premises and had no objections. R. Gomersall moved to grant the request for Raymond Thomas, 24001 Frank Street for a 3 foot side line variance to replace a detached garage, seconded by T. Koberna, and unanimously approved.
