.L <br />• '?= - <br />CITY OF NORTH OLMSTED <br />BOARD OF ZONING APPFATS <br />MINUTES-APRIL 6, 1994 <br />Chairman Gomersall called the meeting to order at 7:30 p.m. <br />Present: T. Koberna, J. Maloney, and R. Gomersall. <br />Ms. Boyle arrived later. <br />Absent: W. Purper <br />Also Present: Building Commissioner D. Conway and substitute Clerk of <br />Commissions R. Wingenfeld. <br />J. Maloney moved to approve the minutes of March 9. 1994, seconded by PZr. <br />Koberna, and unanimously approved. <br />Chairman Gomersall advised all present that, since there were only 3 members <br />present and it would take 3 affirmative votes to approve a request, any applicant <br />who wished to withdraw should do so at this time. He further advised that each of <br />the board mer,ibers present had viewed the premises involved in each case. Each <br />case would be judged on the physical situation peculiar to itself so that in no <br />way is a judgement rendered considered to be a general policy judgement affecting <br />properties and like situations elsewhere. <br />1. Elias Brothers Restaurants, Inc. 26700 Lorain Road. Request for variance <br />(1123.12). Request 56.50 square foot variance for total sign area for a business <br />use; request 39 square foot variance for free standing signs; and request <br />variance to have a second free standing sign (one allowed). Violations of Ord. <br />90-125, Section 1163.11(a); and 1163.12(b)a Request denied 3/9/94, proposal is <br />now based on removing the wall sign. <br />Chairman Gomersall called all interested parties before the board. The oath was <br />administered to Mr. Myles, Director of Operations for Big Boy. Mr. Gomersall <br />stated that at the last meeting, the loard ha.d ruled that the Big Boy statue was <br />a sign, and denied the variance, beeause the representative would not agree to <br />removing any of the existing signage. Mr. Plyles explained that, since then they <br />discussed this with the people at headquarters and it was decided that the wall <br />sign, which is on the opposite side of the door from the statue, could be taken <br />down. The members agreed that this would be satisfactory. J. Maloney moved to <br />grant the request for Elias Brothers Restaurant, 26700 Lorain Road, for 39 square <br />foot variance for total sign area for a business use and a an 89 square foot <br />variance for free standing sio and a variance to have.a second free standing <br />sign (one allowed), seconded by R. Gomersall, and unani.mously approved. Variance <br />granted. <br />2. Raymond Thomas, 24001 Frank Street. <br />Request for variance (1123.12). Request 3 foot side line variance to replace <br />detached garage. Violation of Ord.90-135.02(c)(2). <br />Chairman Gomersall called all interested parties before the board. The oath was <br />admi.nistered to Mr. Thomas. Mr. Gomersall stated that all the members had viewed <br />the premises and had no objections. R. Gomersall moved to grant the request for <br />Raymond Thomas, 24001 Frank Street for a 3 foot side line variance to replace a <br />detached garage, seconded by T. Koberna, and unanimously approved.
