? <br />CITY OF NORTH OLMSTED <br />BOARD OF ZONING APPEALS <br />MINUTES - JCTLY 6, 1994 <br />7:30 P.M. <br />Chanman Gomersall called the meeting to order at 7:30 p.m. <br />Present: T. Koberna, J. Maloney, and R. Gomersall. <br />Absent: M. J. Boyle and W. Purper. <br />Also Present: Law Director M. Gareau, Buildiug Commissioner D. Conway, and Clerk of <br />Commissions Oring. <br />Chairmau Gomersall advised that there were only 3 members present and it would take 3 <br />a?'irmative votes to approve a request so if anyone wished to withdraw his request, he should do <br />so at this time because once a case was called, it would be too late to withdraw. . He stated that <br />one member was out of town, but the fotuth member might arrive later. None of the applicants <br />asked to withdraw. He further advised that each case will be judged on the physical situation <br />peculiar to itself, in no way, is any judgment rendered considered to be a general policy judgment <br />affecting properties and like situations-elsewhere. <br />1. Boston Chicken, 26440 Lorain Rd. <br />Request for variance (1123.12). Request 18 foot front setback variance; request 8 foot side yard <br />variance; and a 12 foot rear setback variance. Also request variance for area of combined lot. <br />Violations of Ord. 90-125, Section 1139.07 and 1139.06. Tabled meeting of Jwie 9, 1994. <br />Refened by Planuing Commission June, 28, 1994. Note: Property is being co-developed with <br />adjacent building. <br />Mr. Wincek asked if they could wait until the forth member is present. Mr. Gomersall stated that <br />he was not sure that the forth member would show up. After some discussion it was decided that <br />they would wait until the end of the meeting in case the other member showed up, and then they <br />could make a decision as to whether they wanted to withdraw or not. <br />2. George J. Doronv Jr., 5151 Lucydale Ave <br />Request for variance (1123.12). Request 6 foot rear yard variance to construct addition to <br />detached garage. Violation of Ord. 90-125, Section 1135.02 (c) (2). <br />Chairman Gomersall called all interested parties before the board. The oath was adininistered to <br />Mr. Dorony. There were no neighbors present and the members had no objection to the request. <br />J. Maloney moved to grant to Mr. George J. Dorony, Jr. 5151 Lucydale Avenue, his request for a <br />6 foot rear yard variance to construct an addition to a detached garage, seconded by R. <br />Gomersall, and unanimously approved. Variance granted. <br />At this point Chairman Gomersall advised that Kenneth Cribel (case 5), 4683 Martin Drive, had <br />withdrawn his request. <br />3. Richard & Donna Rauser, 29502 Wellin on Dr. <br />Request 40 foot variance to construct 6 foot fence on a corner lot. Violation of Ord. 90-124, <br />Section 1135.02.
