.. 7 - <br />.-- <br />4. Axel Hoyer, 23477 Greenwood Lane. <br />Request for variance (1123.12). Request 40 square foot variance for area of shed over the 2% area of <br />? the rear yard permitted. Violation of Ord. 90-125, Section 1135.02(d)(1). <br />Chairiuan Gomersall called all interested parties before the board. The oath was adininistered to Mr. <br />Hoyer who explained that he was going to tear down the existing shed but the location would <br />conform to code. T. Koberna moved to grant a request for Axel Hoyer, 23477. Greenwood Lane for a <br />40 square foot variance over the 2% maximum of the rear yard. Violation of Ord. 90-125, Section <br />1135.02(d)(1). The motion was seconded by J. _Maloney and unanimously approved. Variance <br />granted. <br />5. , Mr. Beverage 27600 Lorain Road. <br />Request for variance (1123.12). Request 1 foot 6 inch front setback variance for location and <br />variance to install pylon sign in prohibited triangular area. Also request variance to list product on <br />identification sign. Violation of Ord. 90-125, Section 1163.12(b) and 1163.03(A)(c). <br />Chainnan Gomersall called all interested parties before the board. The oath was administered to Mr. <br />Hixon, sign contractor, and Mr. Hemandez, owner. Mr. H'vxon explained that the sign would be <br />installed on the rear pole of the existing sign. The members agreed that this would be an <br />improvement. W. Purper moved to grant the request of Mr. Beverage, 27600 Lorain Road, for a 1 <br />foot, 6 inch front setback variance for location and a variance to install a pylon sign in prohibited <br />triangular area. Also to grant the variance to list product on identification sign. Violation of Ord. 90- <br />125, Section 1163.12(b) and 1163.03(A)(c). Mr. Kobema questioned if a variance should be <br />• included for the changeable cop.y portion. Building Commissioner Conway advised that this was only <br />to change the numbers for the lottery and he would not consider that changeable copy. The motion <br />was seconded by T. Koberna, and u.nanimously approved. Variance granted. <br />6. Richard & Pauline Wells. 5955 Burns Road. <br />Request for variance (1123.12). Request 4 foot variance for distance between dwellings. Violation of <br />Ord. 90-125, Section 1135.07. <br />Chairman Gomersall called all interested parties before the board. Building Commissioner Conway <br />clarified that the Engineering Department is going to require them to maintain 5 foot from the outside <br />edge of the drainage pipe (in easement on property) to the edge of the foundation wall, so the <br />Building Department was guessing when they requested a 4 foot variance, if the new site plan <br />presented by Mr. Wells this evening is accurate, only a 2 foot variance would be required since there <br />would be 13 feet between dwellings. Mr. Conway clarified that this house would be 7.5 feet from the <br />property line and the adjacent. house is 5.5 from the line. At this time the oath was administered to <br />Mr. Wells, Councilinau Nasher, and neighbors, Ms. Cooney, Mr. and Mrs. Dorony, Mr. Leib, Mrs. <br />Lally, and Mr. and Mrs. Malone. Mr. Wells explained that they were requesting a new 28 foot by 50 <br />foot house which will be built directly in front of the old structure, which would be removed. The <br />variance is needed to allow additional space between the storm sewer and their house. The new house <br />will be at a 50 foot setback line. Councilman Nasher stated that the residents have protested against <br />this type of variance because the home will be directly adjacent to the existing home. It will be a <br />modular type home, and the residents do not want this is the type of house in the neighborhood; they <br />• would prefer a new structure that would conform to the codes. Mr. Gomersall stated that this would <br />be a 26 foot wide structure which would only be 2 foot closer to the adjacent house. Nlr. Foreman, <br />who lives next door had presented a letter earlier, stated that they want the house to conform to code. <br />3
