Mr. Gomersall amended the motion to read a 6 foot high <br />fence. The motion was seconded by W. Purper, and unaniniously approved. Variance granted. <br />5. Request 25 foot front setback variance; Request 15 front <br />landscape bu$'er; request 25 foot corner lot setback; request 10 foot variance for rear yard <br />landscape buffer; and request variance for access drive that is less than 100 feet from an <br />intersection. Violation of Ord. 90-125, Sections 1139.07 table; 1139.08(a) and 1161.10(a). <br />Heard by Plauning Commission January 10, 1995. <br />Chairmau Gomersall called, all interested parties before the board. Mr. Mongello, architect, <br />Mr. Glazier, owner, and Mr. McKee; property manager, and neighbors, Mr. and Mrs. Pfaff, Ms. <br />Wensink, Ms. Zeh, Ms. Lozada, Mr. and Mrs. McCarty, Mr. and Mrs. Kost, Mr. and Mrs. <br />' Palko, Ms. Hadin, Mr. and Mrs. Phillips, S. Golonka, Mr. and Mrs. Weaver, Mr. Kelly, Mr. <br />May, Mr. and Mrs. Huffnaun, Mr. Hodorowski, Mr. Charles, Ms. Sobey, Mrs. Danchisen, Mr. <br />May, Mr. Miller, Ms. May, Councilinau McKay, and L. Orlowski, a resident of Bailey who was <br />formerly a chairinan of Plauning Commission, came forward. Mr. Gomersall explained the <br />variances and asked that when the neighbors spoke, not to repeat what others have said and to <br />stick to_the variances that are being requested. Mr. Mongello introduced the representatives and <br />explained that this is the final phase to complete the Olmsted Plaza Shopping Center. They have <br />owned the auto glass company build.ing for many years and have been negotiating for sometime <br />with Mr. Passant to buy the corner property with a house on it. During that time, the zoning <br />eodes have changed and because the lots are small, in order to develop the property and be <br />consistent with the existing buildings, they will need variances from the new code. Chairman <br />Gomersall adiniuistered the oath at this time. Mr. Mongello noted that the existing homes (on <br />Fleharty) were set back 40 some feet. He presented a drawing showing the bu.ildable area of this <br />lot if the existing codes were followed and concluded that it wottld allow only for a building 15 <br />feet deep and 140 feet long. He maintained that the owners will work with the residents and, <br />because the children have to wait for the bus on this corner, they would be willing to install a <br />bus shelter similar to the RT.A. shelters. They understand the traffic problems on Lorain Road <br />and have heard that, duriug the Christmas season, Litehouse Pool employees park on Fleharty, <br />but his client cannot control that. Mr. Glazier, one of the owriers, pointed out that the property <br />has been zoned commercial for some time and" they are not requesting re-zoning, the existing <br />buildiug is set back 41 feet, and tlie new building back 50 feet and the corner lot is only 50 foot <br />wide, and a 50 foot side yard requirement would prohibit any building on that property. He <br />pointed out that they have attempted to work,with the community by improving the existing <br />buildings by changing the color of the mansard, installing a fence along the rear yard, and <br />adding landscaping. Mr. Wensink, a neighbor, responded they want 7,000 square feet and it is <br />zoned for 1,800. Mr. Mongello advised that the 1ot coverage was not in violation, they only <br />need variances for setbacks. Mr. Wensink responded that the codes are to control the building <br />and they I?new the codes when they bought the property. Mr. Gomersall pointed out that he <br />knew this property was zoned commercial when he bought the property and codes change and <br />3
