<br />CITY OF NORTH OLMSTED <br />BOARD OF ZONING APPEALS <br />NfIl1UTES - MARCH 1, 1995 <br />Chairman Gomersall called the meeting to order at 7:35 p.m. <br />Present: M. Boyle, T. Koberna, J. Maloney, W. Purper, and R. GomersalL <br />Also Present: Law Director M. C'rareau and Clerk of Commissions Oring <br />W. Purper moved to approve the minutes of February 1, 1995 as written, seconded by J. <br />Maloney, and uuanimously approved. <br />Chairman Gomersall advised those present that it would take three affirmative votes to <br />approve a request and board members have viewed the premises involved. Each case would <br />be judged on the physical situation peculiar to itsel? so that in no way is a judgment rendered <br />considered to be a general policy judgment affecting properties and like situation elsewhere. <br />1. Rini-Rego Marketplace, 47000 Great Northern Blvd. <br />Request for variance (1123.12). Request 29 foot 2 inch variance to enclose existing truck <br />dock. Violation of Ord. 90-125, Section 1139.07 (table). <br />Chairman Gomersall called all interested parties before the board. The oath was acimivistered <br />to Mr. Saleet, arclutect, and neighbors Mr. and Mrs. Paulus, Mr. Powe, Mr. and Mrs. Palko, <br />Mrs. Wensink, Mr. and Mrs. Kost, Mr. Calanni, and Mrs. Schermer. Mr. Saleet explained that <br />when they came before the board last year, they had promised to fix up the rear dock area. He <br />agreed that tlus back area was extremely unsightly and the open dock was deteriorating and <br />did not function correctly because if trucks are parked at the dock the driveway is blocked. <br />T'hey could have just rebuilt without a variance but there would have been no exit; but with a <br />variauce they could redesign the three dock areas, fully enclose them, put in dock levelers, and <br />still have an exit from the building. This will be a brick enclosure with a roof and will extend <br />about 5 feet 4 inches further into the setback. He explained that the truck would back into the <br />dock and a foam enclosure would seal it against the building, thus reducing the noise. In <br />response to the neighbors' questions, he explained: they will still be able to unload three <br />trucks at one time: the existing brick wall behind the dock was about 24 feet long, and will not <br />be extended. It was clarified that, under the existing codes, the dock should be 50 feet from <br />the residential property, but this was existing under the old code and will ouly be 5 feet 4 <br />iuches further than it is now. Mrs. Schermer would like the wall continued behind her <br />property, aud explained that she only had a wood fence. It was explained that this is not part <br />of tlus request and this proposal would be to the advantage of the neighbors since there would <br />be less noise and debris, and it would be a safer condition. Mr. Saleet explained that the dock <br />levelers would be quieter thau the plates they are using now. Mrs. Wensink complained <br />because Rini's were unloading all night long and stated that they call the Police, but they do <br />not respond anymore. Mr. Saleet suggested that they call Riser Foods directly and complain to
