T'hey are going to have to pull the fence down and replace it correctly. The board <br />is not going to get into a rhubarb. Mr. DiGeronimo responded that he would tell them what they were going <br />to get iuto, a big lawsuit, because what the board was doiug was violating every property interest, if they tell <br />these people they have too..... (Mr. Gomersall and Mr. DiGermonimo talking at one time, not clear.) Ms. <br />Boyle asked Mr. DiGermonimo to read what was granted and how it was to be amended. Mr. DiGeronimo <br />responded that he was readiug the transcript and the transcript read southeast. Mr. Gomersall stated that lie <br />was going to make a motion (regarding the Matthew Suvima request, 25191 Butternut Ridge Road) that the <br />wording be chauged for the meeting of February 1 st to read on the fourth line, where he referred southeast <br />to read southwest iu accordauce with the plan submitted and drawn by the board. The motion was secouded <br />by J. Malouey. Mrs. Fritz stated that regardless of whether there was a miscommunicatiou, and regardless of <br />whose part the iniscommwucation was, the feuce is still on the Suinina's property, and she thought to ask <br />people (to move it ?) siuce they are all youug people and they like to think they have friendly neiglibors. Mr. <br />Gomersall iuterrupted and stated that a lot of people caine to the meetiug and there was a lot of negotiation, <br />a lot of discussion, and there was a lot of coucern about tlus fence, and he made it quite clear. (Ms. Fritz and <br />NIr. Gomersall talking at one tune, uot clear). Mr. DiGennouimo asked if Mr. Gomersall knew what ex post <br />facto was, and claiified that they could uot chauge a law after they made a law. Ms Boyle stated that it was <br />a clerical eiTor, you may cliauge it. ( Ms. Boyle, Mr. DiGermonuno, N1rs. Suinma and Ms. Fritz were all <br />talkiug at once and it was not clear and contiuued to argue wlule Mr. Gomersall tried to restore order) Mr. <br />Gomersall asked for a vote on the motion. Mr. Koberna asked for clarification of what was being voted on. <br />He was advised that they were votiug on claiification of the word and also add'uig in accordauce with the <br />plan as submitted at the ineetiug. Mr. ICobei-ua asked if there was uotlung about taking down the fence. Mr. <br />Gomeisall responded that this would require that the fence be taken dowu. Mrs. Summa stated that tlus was <br />ridiculous. Mr. Koberua did not agree with the motion. Roll call on motion: Gomersall Maloney, and <br />Purper, yes. Mr. Kobeiua, no. Ms. Boyle abstained. (Ms. Boyle had uot been at the original ineetuig) <br />Motiou cai-ried. Cliau7nan Gomersall advised that the meeting was over. The ineetiug was adjoui-ned at 9:20 p.m. <br /> <br />R.
