sometlung else in the city. Mr. Conway advised that if a variance is granted, he would like it only to <br />_ pertain to the current use, not a subsequent use. R Gomersall moved to approve the use variance <br />because of practical difficulties and unnecessary hardship (buildings are constructed). To grant a <br />variance to use property zoned as Single Family "C", Residential, for a commercial use. Also to grant <br />a 30 foot variance for side yard set back on east; a 45 foot variance for side yard set back on west <br />and a 3 foot variance for rear yard setback on north. Also to grant a 16.5 % variance for land area to <br />be occupied by buildings (25% allowed, 41.5% requested). Violation of Ord. 90-125, Sections <br />1123.12; 1135.01; 1139.07; and 1139.05. The above variances are granted with the following <br />conditions: that an approved storm drainage and retention system be installed; that a 4 foot mound <br />with a 6 foot fence with evergreens on either side of it be installed on the north boundary of the <br />property; that a 6 foot board on board fence should be installed on the east and west lines starting <br />from the permauent structures back to the back line; that the litigation currently pending before <br />common pleas court will be resolved to the satisfaction of the North Olmsted Law Department; that <br />corrections necessary to bring the buildings into building code compliance be completed; and also <br />that the use variance that is granted is only granted so long as the property is used for its curreut use, <br />namely storage units. This variance has been mutually agreed upon with the applicant. The motion <br />was seconded by J. Maloney. Roll on motion: Gomersall, Maloney, Koberna, and Purper, yes. Ms. <br />Boyle, no. Motion carried. Variances granted. <br />The members would like the especially long variance requests separated by lines on the agenda, so <br />that it is easier to follow each segment of the request. <br />The meeting was adjourned at 10:00 p.m. <br /> <br />R.
