Maloney moved to grant the mutually agreed upon amended proposal of Ron Wagner, <br />4324 Root Road. for a 37 square foot variance to construct shed which exceeds the permitted 2% coverage <br />of the rear yard. Also, request 5 foot rear yard variance for location of shed_ Violation of Ord. 90-125, <br />Sections 1135.02 (d-1) and (d-4). The motion was seconded by T. Koberna and unaniinously approved. <br />Variances granted. <br />14. James Reese, 5991 Coluinbia Rd. <br />Request for variance (1123.12). Request a 38 foot front setback variance to build a garage in front setback. <br />Violation of Ord. 90-125, Section 1135.06 (a). Request an 8 foot height variance for garage. Violation of <br />Ord. 90-125, Section 1135.02 (c-1). <br />Chau-inan Gomersall called all interested parties before the board. The oath was administered to Mr. Reese, <br />Mrs. Reese, Mr. Pascura, Mrs. Pascura, and Mr. Champa. Mrs. Pascura explained, in order to avoid the cliff, <br />they would like to ainend the request and move the garage 10 foot forward (up to the dotted liue shown on <br />the plan). Mr. Gomersall clarified that the old garage will be demolished and a uew garage will be built 10 <br />feet fi-om the present locatiou. The neighbois had no problem with the request. Nli-. Kobema noted that <br />there is only 12 feet from the proposed line to the property liue, wluch is uot enough length for a car. He <br />suggested that for theu• own safety aud insurauce puiposes, the garage be moved back at least one car length <br />(17 feet). Mr. Gomersall and Mr. Koberna thought 12 feet was sufficient. The meinbers came to a consensus <br />that the garage be located 15 feet from the property line, and it was clarified this would allow the garage to <br />be inoved 7 feet back fi-om the present location (rather than 10 feet). <br />J. Chauman Gomersallexplained, for safety reasons, t3us board will requu-e a fue proof <br />wall be iustalled on the inside of the garage. Assistant Building Commissioner Rymarczyk clarified the <br />portion of the roof on the rafter, witlun the fifteen feet, would also have to be drywalled. <br />7
