<br />back there to worry about. He had to scrape the debris into the middle of the alley way to get the
<br />Building Inspector to decide it was bad..Then people came out and scooped it up. He lives behind the
<br />strip that has Pier One Imports, LaSalle Interiors, and the worst neighbor Carriage Carpet. He does not
<br />want tlus to happen to the neighbors on-the other side of the development. So he is in favor of their
<br />opinion.
<br />Mrs. M. Diver, 24711 Mitchell Drive, advised that she is here to discuss their concerns. We both have
<br />concems about this rezoning. They worked together along with Mr. Skoulis and the city admiuistration
<br />when it was time to take it from residential to the Office Building District. They sat down with the
<br />Biskind people for many montlis and they were told to work the deal to go with the office building with
<br />the landscaping around, and that is what they did. Now they are fighting this again nine years later. The
<br />definition of a corimmunity is a unified body of individuals living in a particular area; the definition of a
<br />neighborhood is one living or located near another to adjoin immediately or lie relatively near to. We are
<br />a community, comprised of businesses, small and large, multi family dwellings, and single homes. All in
<br />our community, at one time or another, have expressed their concems regarding the traffic problems.
<br />That is underscored recently with the letters you have read recently in last fall's elections from the
<br />Westlake residents, comparing us to what they do not want in their community, as was stated about the
<br />Promenade, and of course that did lose. Their neighborhood is comprised of young, middle aged, and
<br />senior citizens, all of whom go home at night after they worked a hard day, when they go home they
<br />want to rest. Many of these people have concems about their positions and jobs because of down sizing,.
<br />etc. Now they have this, are they going to lose the quality of life that they lead with their families in
<br />their neighborhood. In this neighborhood, there are neighbors adjoining tliis property, a.Vietnam vet, a
<br />child who is physically challenged, a neighbor that has overcome a brain hemorrhage, a lady with a
<br />muscular problem; all these people have extra things that they are fighting, in addition to the day to day
<br />things. Now we are going to have a new neighbor, Home Depot, if this is approved. She and her
<br />husband have grave concems about this neighbor, not only about the traffic, but about some potential
<br />hazards. She presented an article from the May 24th, 1995, Patriot Ledger in Quiucy, Massachusetts,
<br />which is about a Home Depot and a toxic fire. Chemicals that are stored in a Home Depot such as
<br />fertilizers, pool chemicals, pesticides, plastic lawn furniture caused a toxic mix of hydrogen chloride
<br />and other gases. There was a problem because of the way the stacking was done with the merchandise
<br />within the store that was up so high that the firemen, when they came in to put the fire out, could not
<br />get it out fast enough. The wiring inspector was quoted as saying "you had a minutes to get out of the
<br />sfore - it happened so fast". They had to call in a hazardous materials team. She thinks that the city can
<br />understand their concems being residents so close to a store with these kind of supplies with the
<br />neighbors who have physical limitations. They have a nice quite residential neighborhood, some
<br />residents have been their. over 30 years when it was first built. Now they have to worry with what the
<br />new neighbor would be. She has concems, what are the legalities, even for the board members that
<br />approved such a thing, if such a catastrophe would happen. She asked the members to please think long
<br />and hard about the consequences of when a rezoning would happen for Parcel "E".
<br />Mr. Poffenberger, who lives next door to Mrs. Diver, wanted to stress the importance of the trust m the
<br />city and its representatives. They cannot allow a new resident to spend over $150,000. on a house and
<br />then be promised by the city and the Realtor that they could be guaranteed, be absolutely promised, that
<br />the property behind your house is zoned for office and no one has to be worried about it being changed
<br />since it is in the Master Plan and in the agreement. When he saw the woods, he knew that they would
<br />have to be turned into something. So he went to the city and received a copy of everything so he was
<br />assured and was absolutely positive that he could take a chance and purchase his house. The Master
