Building Commissioner Conway wondered if a time line can be suggested <br />that would require the proposal to come back to plavuing commission if the time line was not met. <br />Assistant Law Director Dubelko believed if each individual phase separately meets the zoning code <br />there should be no problem with the proposaL Mr. Conway rephrased the question asking if planning <br />commission can grant an extension beyond one year, as after one year the approval is nornially <br />expired. Mr. Dubelko was not aware of anything in the code that would allow planning commission to <br />grant such an extension. Mr. Tallon believed if all three phases were not completed within one year, <br />but no changes were made to the proposal, it could come back as a minor change. Councilman <br />Nashar questioned when the curb cut on Barton Road would be constructed. He was advised by Mr. <br />Robinson the curb cut on Barton Road would be done in phase I as is shown in blue on the plans. Mr. <br />Nashar wondered if traffic would be coming in and out of this curb cut. Mr. Robinson confirmed <br />traffic would be coming in and out on Barton. W. Nashar requested that the Barton Road curb cut be <br />entrance only access as the residents on South Barton were concerned about the increased traffic. Mr. <br />Conway advised there is no increased traffic at this time as the school and facilities are a future portion <br />of the proposal. Mr. Nashar clarified, if Phase I incorporates part of the South Barton property in the <br />future there would be increased traffic. Mr. Robinson argued the second entrance is needed due to the <br />removal of the entrance on Charles Drive. Mr. Tallon was concemed about having a cut through with <br />no building. Mr. Manning believed this would not be used as a cut through as one cannot gain any <br />ground. Mr. Tallon suggested completing the curb cut, but closing it offuntil all three phases are <br />completed as it will not be needed uutil the Charles Road Drive is removed in phase III of <br />construction. Mr. Robinson agreed to this request. Mr. Conway clarified that the commission is <br />permitting installation ofthe drive, but requesting that it be temporarily sealed off until all three phases <br />are completed. W. Robinson advised making the Barton Road curb cut entrance only would increase <br />the flow of traffic on Charles Road. Mr. Deichmaun advised one advantage to an exit on Barton is <br />that people coming from the church, attempting to travel west on Lorain, would have a traffic light to <br />make that left turn on Lorain. 1Vlr. Phillips, an 18 year resident, did not believe an exit on Barton was <br />a benefit to the residents on Barton Road. He advised Barton Road had no cu.rbs and he believed this <br />curb cut would be potentially dangerous to the children in this neighborhood. <br />R. Tallon motioned to approve the request of Christ The King, 30635 Lorain Road to construct <br />addition and parking lot renovations in phase construction. Origiually approved by planning <br />commission February 27, 1996. The motion is to allow phase I to go ahead with the d.riveway on <br />Barton to be sealed off until further phases are developed. Per Mr. Herbster's request, W. Tallon <br />clarified this could be opened up if during construction the traffic flow on the site was altered in any <br />way. The motion was seconded by A. Manning. Roll call on motion: Tallon, Manning, Cameron- <br />Alston, Brennan, Koeth, and O'Rourke, yes. Mr. Herbster, no. Motion carried. <br />N. NEW DEVELOPMENTS AND SUBDIVISIONS: <br />1) Downing; Company Consolidation Plat (La-Z-Bov Furniture? <br />The proposal is to combine permanent parcel numbers 231-33-016 (formerly Long John Silver site) <br />and 231-31-026 (formerly BP Car Wash site) into one (1) parcel (site of approved La-Z-Boy <br />Furniture). Location is the northeast corner of Lorain and Root Roads. Zoning is Retail Business, <br />General, entirely and the proposal conforms to frontage and area requirements. <br />Mr. Stitz, architect presented the proposaL There were no objections to this request. <br />R.
