control over it. Mr.Coyne stated that they cannot say for sure that this owner would be the developer <br />of the property if it were rezoned, but it could happen. Mr. Skoulis stated if this property were <br />rezoned aud a proposal made, the homeowners would like some iuput as to buffering, landscaping, <br />and what is to be built. The developers responded that the development would be built to code and <br />would be discussed at open planning commission meetings. Mr. Skoulis clarified that he was asking if <br />Biskind Development would be willing to allow the residents to have input outside of the plannivg <br />commission meeting, prior to coming to a meeting as they did prior to the rezoning to Office Building <br />District. Mr. Corsi responded that they would consider having a meeting, but their conteution was <br />that any proposal would be designed to code. Mr. Skoulis stated that their group has a lot of concems <br />about what is going to be built, and the plan that was submitted looked like an army base. They believe <br />that this is the worst proposal that the developers could come up with. They have seen no renderings <br />of what the buildings will look like, they only saw a plan showing where the buildings will be. It <br />appeared that there would only be about 20 foot setbacks from property liries to the back of the <br />garages. He realized that this meeting was only to discuss the rezoning of the land, not the proposal <br />itselt however, they want to be assured that if the rezoning were approved., it would be an asset to the <br />city and would enhance that area. They do not want to see auytlung like Carleton Place, which just <br />burned. He questioned if this plan is their final plan, or if they intended to come back with different <br />plans. He realized that they were not here to discuss the proposal, but it is a concem of their members, <br />and would involve whether or not they would support the rezoning request. They are also concerned <br />with the access from Westview Drive and Columbia Road. It was agreed when the Office Building <br />zoning was cliscussed, not to have access from Westview Drive and the access on Columbia Road is <br />right at the beud in the road, directly opposite the adjacent apartment bu.ilding drive. He questioned if <br />traffic coming from Brookpark could make a left hand turn into the existing apartments and believed <br />that traffic would back up on Brookpark Road. H'is association would like some of these questions <br />answered before they support this proposal. They have.always wanted to have this land developed for <br />multi-family as it was originally zoned. He questioned why there could not be access from Brookpark <br />Road. Mr. Corsi responded that the accesses shown were existing off Columbia and Westview and <br />they did have the right to access those roads. They do not have a curb cut granted (off Brookpark) <br />from the State of Ohio for that side of the street, and they do not require it, it is not required by code, <br />and the cost of acquiring a cuxb cut from the State of Ohio is prohibitive, and the State would not <br />consider that the access would be necessary for a residential use. Mr. Skoulis noted that they do not <br />actually have a permit from the State, but it is applied for uid approved; they only need to file the <br />papers and pay the State a fee, because opening up that land to Brookpark Road would increase the <br />value of the land and they generally, not always, would have to p ay for the increased value of the <br />property. He wondered ifthe developers had a development plan, a starting date, and once the <br />rezoning was approved, how long would it be before they would start building. Mr. Corsi responded <br />that the plans were what they had submitted, and once the rezoning is approved they would look at <br />whether they would develop the land themselves, or possibly turn it over to another developer. Mr. <br />Skoulis stated that the residents ofPark West were not too sure that this developer ever intends to <br />build apartments here, they believe the developer is going through a formality, a ploy. It is their <br />opinion that they still intend to go through with their law suits and they want this request to be turned <br />down, so that when they go to court that can say that they tried to put in multiple units and were <br />turned down. Chairmau Tallon stated that they cannot judge someone else's intentions, and they are <br />presenting what they are required to present. They do not have to present drawings since this is a land <br />use. Mr. Skoulis stated that, for the record, this will have to go on to a referendum, since Building <br />Commission Conway stated that the city was at 27%, not 20%. Mr. Tallon stated that this was up to <br />someone else (the attorneys). Mr. Skoulis concluded that their organization would accept multi family, . <br />if it would be something that was acceptable.
