He sold lus lots to Mrs. McCroiie and she dividecl tli.em to niake Uiggei- lots, she divided five <br />lots ivto four. He stated noted that Joe Sunmons built ou one 45 foot lot at oue time and then built <br />next door later. Mr. Subail did not believe that every lot that coiues ui for a building permit gets the <br />same kind of review that the Law Director has done for tliese lots. He believed that some lots were <br />developed without these restrictions. 1VIr. Tallon questioned if he was accusiug the commission of <br />doing soinetlung shady. Mr. Suhail stated that he was ilot accusiug tlie plauning cotnmission, but other <br />lots that did not come before the coinmissiou. <br />R. Tallon stated that regarding that Broxbouive Road Exteiisiou (east): Iulprovement Plaus Revised, <br />Continued from July 22, 1997 P11111llllg CO1T11T11SS1011 meetiug, a pr,oposal to extend/continue <br />Broxbourne Road (paveiiient and water maui) approxiinately two huudred forty two (242) feet to the <br />east within a platted iight of way and fi-ontuig five (5) platted lots. Revised plans include an upgrad.ing <br />of pavement staudards, ancl a Dedicatiou Plat for additional right of way ou the north side of <br />Broxbouiue Road, he was inoviug to deny the Dedicatioii Plat foi- the iight of way of Broxbourne <br />Road since the Dedication Plat cioes not meet the requirements of the city of North Olmsted, and to do <br />this would be plattiug non-confoi-iiung lots. T'lie motion was secondea by A. Mauuing. Mr. Dubelko <br />advised that there was a gray zoue in the code, since in otlier cases a proposal must be refened to <br />board of zoving appeals, so in fau-uess to the developer, if he wants to, go to board of zoning appeals <br />to seek a variauce, it would be best not to deny the plat, but to make a reconuneudation to the board <br />of zouiug appeals. The developers preferred to go to the board of zoning appeals. Chaii7nan Tallou withdrew his motion. <br />Mr. Mannuig withdrew the second. <br />R Tallou moved to refer the Broxboiume Road Exteusion plat to the board of zouing appeals with the <br />recommendatiou that the board of zoning appeals deuy tlie variance to build on these lots since they <br />are way uon-conforming and the code does stipulate that tliey can be combuied and brought up to <br />these standards. We, as a planuing commissiou, feel that it is uot in the best interest of the safety, <br />health, and welfare of the citizens of North Olmsted to create uon-conformiug lots. The motion was <br />seconded by was seconded by A. Manning, and iuianiulously approved. <br />Mr. Suhail asked what tlie procedure would be if the developer wanted to build one house and <br />improveineuts on sublot 158 how would he have to go about it. T1us would be going across lots 156 <br />and 157. City Engineer Deiclunann advised that he would have to develop the street up to the lot that <br />he will be asking for a building permit for. 1VIr. Suhail asked if he would have to present a dedication <br />plat for 156 and 157. Mr. Tallon stated that he would have to get peiYnissiou from the owners to do <br />that. <br />V.
