t <br />? <br />overIlowing. He noted the city does not have any accurate records showing where this water is <br />flowing. Several of the neighbors drain to the back. Mr. Kazak stated, according to the memo from <br />engineering, the Root Road ditch is not large enough to accept the water. Mr. Costa explained the <br />water is flowing South, however, the records indicate it is flowing North. Mr. Kazak noted the intent of <br />delaying this case was to get engineering to propose a solution. Mr. Costa advised, the entire <br />neighborhood has been asking the city to solve this problem for years, but have not had any luck. <br />Councilmau Nashar identified the main problem is Root Ditch needs to be cleaned out, but state money <br />will be needed thereby delaying that project. He noted Service Director Bohlmann advised the city will <br />need to eventually do storm water repair work, but could not confirm a date for this project. Mr. Costa <br />believed a 40 foot lot is inadequate for a house. Mr. Kazak noted the majority of the lots are 40 foot <br />wide. Building Commissioner Conway advised if there is confusion on if the lot is large enough or if the <br />house is to large it is out of this boards jurisdiction. He elaborated that will be addressed before the <br />board of zoning appeals. Mr. Brunswick, owner of the lot, explained everyone seems to d.rain into this <br />vacant lot. He believed the best thing to do with this lot is to build the home, as this will add to <br />everyone's property values and cure the drainage problem on this lot. Mr. Kazak wondered if a French <br />drain could be installed. Mr. Dunlap has not looked into the expense, but did not believe this was his <br />responsibility. He agreed to consider installing a French drain. Mr. Brunswick explained, several years <br />ago the city did drainage work in this area which did improve the conditions somewhat, but did not <br />rectify the situation totally. Mr. Piar would like the 'drainage systera to match what the City Engineer <br />has recommended. Mr. Costa wondered what recourse tlie neighbors would have if the drainage system <br />does not work properly. Mr. Dunlap doubted installing a house on this vacant,lot equipped with the <br />proposed drainage would negatively effect the surrounding properties. Mr. Costa noted there are no <br />guarantees the neighbors will not flood more if this proposal is permitted. He believed the two houses <br />recently put in down the street have compounded the problem. The neighbors noted one lady keeps <br />filling the ditch in which worsens these conditions. Mr. Nashar wondered if Mr. Dunlap can hold off on <br />building until the Service Department has the opportunity to perform some drainage work on this street. <br />Mr. Dunlap explained this is the building season and he wou.ld like to begin as soon as possible. Mr. <br />Kazak noted engineering has identified the problem but has not covfirmed any plans for a solution. He <br />advised the residents to start attending:council meetings explaining their predicament. Mr. Spoerke <br />stated he drove down this street last week after a rain storm. The ditch in front of the proposal had an <br />inch of water, but the level continued to increase until it overIlowed at the southern most end of the <br />street. Building Commissioner Conway advised, although d.rainage is an engineering issue, the . <br />engineering department does not physically do the work. He elaborated firms and money has to be <br />provided in order to perform this function. Mr. Kazak reiterated this issue should be brought out at a <br />council meeting. He encouraged the residents to start attending council meetings in force, and demand <br />that this problem be add.ressed. <br />B. Piar motioned to approve the proposal of Timberview Homes, P.P. #235-12-61, vacant lot located <br />between 5581 and 5609 South Porter Road with the stipulation that the Engineering Departments <br />recommendations, in the conespondence dated Apri13, 1997, be followed word for word. The motion <br />was seconded by D. Spoerke and unanimously approved. <br />Mr. Costa requested clarification on the motion. Mr. Kazak replied that the board is following the <br />Engineering Departments recommendations that Timberview Homes put in a retention basin on their <br />site to contain the water and prevent it from overtlowing.
