Violation of <br />Ord. 90-125, Section 1123.06 (a). Continued by board of zoning appeals from meeting of 12/11/96. <br />Chairruau Gomersall called all interested parties before the board. The oath was administered to Mr. <br />Duulap, contractor. Mr. Gomersall questioned why the trailer had to remain on the property since <br />the house was already u.nder cover. Mr. Dunlap explained that he is also buildiug three houses on <br />Decker Road, and this is on his own property. Mr. Gomersall believed that the trailer should be on <br />the property where he is building. Mr. Dunlap explained that he used this as an office while he was <br />building lus residence. He will be moving the office iuto the model home on Decker Road, and he <br />could be moved in witlun 30 days. The members agreed. J. Maloney moved to grant to Tunberview <br />Homes, 29275 Hastings Drive an agreed modified request for a special permit to have a temporary <br />construction trailer in a residential district for a period of thu-ty days. Violation of Ord. 90-125, <br />Section 1123.06 (a). The motion was seconded by T. Koberna, and unanimously approved. Special <br />permit granted. <br />3. Request 11.5 foot side yard variance <br />at north property line and a 21.3 foot side yard variance at south property line. <br />Violation of Ord. 90-125, Section 1118.02( fl(2)(b) (50 foot minimum side yard required.) <br />Request 5 foot variance for driveway at north property line.(10 foot required.) aud a 7 foot <br />variance for driveway at south property line (10 foot required.) <br />Request 15 foot variance for parking area at north properiy line (20 foot required.) and a 20 foot <br />variance at south property line. (20 foot required.) <br />Violation of Ord. 90-125, Section 1118.02(fl(3) <br />Request 10.5 foot height variance for existing structure. The oath was administered to Mr. <br />Moran, owner, Mr. McIntyre and Mr. Ebert, attorneys, and neighbors, Mrs. Eccleston, Mr. and Mrs. <br />Dingess, Mr. and Mrs. Tirka, Mr. & Mrs. Buechler and Mr. Klimkowicz. Mr. Gomersall asked that <br />anyone who speaks should not repeat what another person has said. He advised that there was a <br />letter from Ed and Caroline Dingess which has been put in the record. He advised that the way the <br />variance reads, the first variance would be to use the residence as an Adult Group Home, this is in <br />error and should not have come to this board. The planning commission should have ruled on a <br />conditional use permit as opposed as a use for a residence. This board will not rule on the conditional <br />use permit, only on the request for variance from the north property line, the south property line, plus <br />the variance for the height. This board will not rule on the conditional use permit. He explained that <br />this will be ruled on at the next planning commission meeting. The clerk advised, the next planning <br />commission meeting will be February 25, 1997 and notices will be sent out. Mr. Gomersall added <br />this will be ruled on at planuiug commission depending on tonight's outcome. Mr. Ebert believed the <br />conditional use permit should be ruled on first. He elaborated the conditional use permit is a part of <br />the presentation. W. Gomersall believed the inclusion of the request for_conditional use permit, in <br />the overall package is fine, but this board will be:looking at the variance9'requested. He noted the <br />two may intertwine in discussion, however this board will only rule on the variances requested. Mr. <br />Gomersall read aloud the variances requested tonight.
