? , CITY OF NOR'I'H OLMSTED BOARD OF ZONING APPEALS MINUTES - MARCH 5, 1997 Chairman Gomersall called the meeting to order at 7:35 p.m. Present: T. ICoberna, W. Purper, P. Miller, and R. Gomersall. Absent: J. Maloney. Also present: Building Commissioner Conway and Clerk of Commissions Oring. Law Directar Gareau arrived during the discussion of the first request. W. Purper moved to accept the minutes of February 13, 1997 meeting as written, seconded by T. Koberna, and unanimously approved. Chau-man Gomersall advised that each case would be judged on the physical situation peculiar to itsel? so that in no way is a judgment rendered considered to be a general policy judgment affecting properties and like situations elsewhere. He explained that it would take three affinnative votes to approve a request and building permits for all variances and special permits granted may be picked up Monday at the Building Department. 1. Custom Tint (Harmon Glass) 25770 Lorain Road Request for variance (1123.12). Request a variance to have two business' on a legal non-conforming pylon sigu. Violation of Ord. 90-125, Sectiou 1163.12 (H). Note (1): This non-conforming pylon sign must be removed by January 1, 1998. Note (2): Custom Tint will remove their preseut siguage (which was installed without permits) ifthis proposal is passed. Chau-inan Gomersall called all interested parties before the board. The oath was administered to Mr. Chechowski, sign contractox. It was clarified that this is the same sign that was presented at tlie last meeting, but had not been voted on since the Building Department had not had time to figure the variances. The members questioned if a variance was needed for the building sigu. Building Commissioner Conway stated that the building sign was not listed as needing a variance so apparently it conformed. The members had discussed this previously, and had no objection. W. Purper moved to grant a request of Custom Tint (Harmon Glass), 25770 Lorain Road, for a variance to have two businesses on a legal nou-conforming pylon sign. Violation. of Ord. 90-125, Section 1163.12(H) with the Note: that this non-conforming pylon sign must be removed by January 1, 1998 and 2) Custom Tint will remove their preseut signage (which was installed without a permit) if this proposal is passed. The motion was seconded by T. Koberna, and unanimously approved. Variance granted. 2. Jerome Barrett, 24125 Lebern Dr. Request for variance (1123.12). Request the following variances for existing shed: a two square foot variance for area of shed in excess of 2% of the rear yard area and a 5 foot rear setback variance. Violation of Ord. 90-125, Sectiou(s)1135.02 (Dl) and (D4). Chairman Gomersall called all interested parties before the board. The oath was administered to W. and Mrs. Barrett, and neighbors, Mrs. Thaxtou, Mr. Prior, Mr. and Mrs. Thompson, Mr. and Mrs. Laureut, Mrs. D)iver, a resident of another neighborhood, and Councilman Lind.
