? <br />, <br />CITY OF NOR'I'H OLMSTED <br />BOARD OF ZONING APPEALS <br />MINUTES - MARCH 5, 1997 <br />Chairman Gomersall called the meeting to order at 7:35 p.m. <br />Present: T. ICoberna, W. Purper, P. Miller, and R. Gomersall. <br />Absent: J. Maloney. <br />Also present: Building Commissioner Conway and Clerk of Commissions Oring. <br />Law Directar Gareau arrived during the discussion of the first request. <br />W. Purper moved to accept the minutes of February 13, 1997 meeting as written, seconded by T. <br />Koberna, and unanimously approved. <br />Chau-man Gomersall advised that each case would be judged on the physical situation peculiar to itsel? <br />so that in no way is a judgment rendered considered to be a general policy judgment affecting <br />properties and like situations elsewhere. He explained that it would take three affinnative votes to <br />approve a request and building permits for all variances and special permits granted may be picked up <br />Monday at the Building Department. <br />1. Custom Tint (Harmon Glass) 25770 Lorain Road <br />Request for variance (1123.12). <br />Request a variance to have two business' on a legal non-conforming pylon sigu. <br />Violation of Ord. 90-125, Sectiou 1163.12 (H). <br />Note (1): This non-conforming pylon sign must be removed by January 1, 1998. <br />Note (2): Custom Tint will remove their preseut siguage (which was installed without permits) <br />ifthis proposal is passed. <br />Chau-inan Gomersall called all interested parties before the board. The oath was administered to Mr. <br />Chechowski, sign contractox. It was clarified that this is the same sign that was presented at tlie last <br />meeting, but had not been voted on since the Building Department had not had time to figure the <br />variances. The members questioned if a variance was needed for the building sigu. Building <br />Commissioner Conway stated that the building sign was not listed as needing a variance so apparently <br />it conformed. The members had discussed this previously, and had no objection. W. Purper moved to <br />grant a request of Custom Tint (Harmon Glass), 25770 Lorain Road, for a variance to have two <br />businesses on a legal nou-conforming pylon sign. Violation. of Ord. 90-125, Section 1163.12(H) with <br />the Note: that this non-conforming pylon sign must be removed by January 1, 1998 and 2) Custom <br />Tint will remove their preseut signage (which was installed without a permit) if this proposal is passed. <br />The motion was seconded by T. Koberna, and unanimously approved. Variance granted. <br />2. Jerome Barrett, 24125 Lebern Dr. <br />Request for variance (1123.12). <br />Request the following variances for existing shed: a two square foot variance for area of shed in <br />excess of 2% of the rear yard area and a 5 foot rear setback variance. <br />Violation of Ord. 90-125, Sectiou(s)1135.02 (Dl) and (D4). <br />Chairman Gomersall called all interested parties before the board. The oath was administered to W. <br />and Mrs. Barrett, and neighbors, Mrs. Thaxtou, Mr. Prior, Mr. and Mrs. Thompson, Mr. and Mrs. <br />Laureut, Mrs. D)iver, a resident of another neighborhood, and Councilman Lind. Mr. Gomersall <br />explained the request. Mr. Barrett explained that he installed his shed without a permit and he was
