Violation of Ord. 90-125, Section 1135.08(a). <br />Chairman_ Gomersall called all interested parties before the board. The oath was admivistered to D. <br />Seadin, contractor. Mr. Maloney stated that because this was irregularly shaped lot he had no problem <br />with the request and believed it would be an improvement. The members agreed. <br />T. Koberna moved to grant the request for Andrew and Mary Check, 4145 Kew Drive for a special <br />permit to add to non-conforming dwelling (rear setback). Special permit required Ord. 90-125, Section <br />1165.02(b)(2) and also to grant a 27 foot rear yard setback variance to construct enclosed patio. <br />Violation of Ord. 90-125, Section 1135.08(a). Bridg,eport Subdivision Latina and Latina Builders and Hyman Builders, Inc. <br />Sublots 9 through 20, and 28, 29, 33 Bridgeport Dr.; s/148 Sharon Dr.; s/ls 38-39 Woodview Dr. <br />Property located between Tree Lane, Woodview Drive and West 231 Street. Request for variance <br />(1123.12). Request 10 foot rear yard variances for 18 sublots in subdivision. <br />Violation of Ord. 90-125, Section 1135.08(a). <br />Chairmau Gomersall called all interested parties before the board. The oath was adininistered to Mrs. <br />Latina, builder, S. Block, who developed the property, and residents, Mrs. Deucher, Mr. Tighe, Mrs. <br />Smally, Mr. Baddour, and Mr. Czarnecki. Mrs. Latina corrected the request and advised that it should <br />have been for sublots 6 through 20, not 9 through 20 thus increasing the variance request for 21 <br />sublots. The other sublots will be the same as listed. They are asking for 40 foot rear yards, instead of <br />50 foot as required. They are requesting variances for the houses without basements, where a larger <br />house is needed. It was clarified that the variance was needed from the rear of the house to the back <br />property line. Mrs. Deucher objected because this is reducing the land which retains water. Mr. <br />Gomersall explained the request. It was clarified for Mr. Czarnecki that his property did not back up to <br />one of the lots for which they are asking a variauce. Mrs. Latina explained the request to the neighbors. <br />She explained that she had been building in this area, including North Olmsted, for the past 35 years <br />and was familiar with the zoning and building codes. When she initially became involved with the <br />project, she had been told that she had to have a 60 foot wide by 145 foot deep on Sharon and <br />Woodview and 63 by 137 foot on Bridgeport Village Drive. She was also told that the front setback <br />should be 50 feet, the rear setback would be 40 and the sides would be 7.5 or 10 and 5 feet. While she <br />was talking to City Engineer Deichmaun about various items includ.ing the homeowners concerns and <br />problems, she was again told that she needed a 40 foot rear yard setback. He also referred her to the <br />Building Commissioner and she talked to him regarding the houses. She talked further with an engin.eer <br />from Western Reserve Engineering who also told her 50 foot front yard, 40 foot rear yard, and 7.5 or <br />10 and 5 foot side yards. After doing a market study, it was determined that the buyer would be <br />young professionals who wanted something more than a home that looks like a box. Then after <br />designing homes that would meet their standards, getting the engineering done, then pre-selling some <br />of the homes, receiving building permits, and starting construction, they were stopped because of the <br />8
