BOARD OF ZONING. APPEALS NOVEMBER 12, 1986 PAGE 4 <br />property, it is not visib le from Brookpark; and that this business has less <br />sign area than is allowed by code. He presented a picture showing the <br />Brookpark set b ack and stated that there is a definite problem that is not <br />common to any pther building on Brookpark. He further stated that there is <br />more traffic on Brookpark than on Lorain Road. Mr. Remmel stated that the <br />Board had previously granted another variance with the provision that no pole <br />sign.be erected on the Brookpark side of the property and that Planning Commis- <br />sion had requested that no signs be permitted on Brookpark. Mr. Bugala <br />stated that this business had previously been allowed a variance to display 6 <br />cars in the front and now has far more that that number. Mr. Gallina stated <br />that denying this request would be denying Great Northern Dodge the full use <br />of their property. Mr. Grace stated that since the sign is not obtrusive and <br />is not a pole sign, he sees no objection to it and believes that the owner <br />should be able to use the full extent of his property. C. Remmel moved to <br />grant this variance, seconded by R. Bugala. Roll call on motion: Remmel, <br />Bugala, and Gomersall, no. Mn?-' Grace, yes. Motion failed:to pass.. Variance <br />denied 8. James E. and Julie M. Swann, 4530 Clague Rd. <br />Request for variance (1I33.13). Request 92 sq. ft. variance and location <br />variance for tool shed (to be used temporarily until garage is constructed). <br />Violation of Ord. 62-33, Section 1151.04-D. <br />Chairman Remmel called all interested parties before the Board. The oath was <br />administered to Mr. and Mrs. Swann who explained that there is a foundation <br />for the shed on the property and they only want the shed until they can con- <br />struct a garage next year. It was clarified that shed will only be 8' high. <br />Board agreed this could be constructed on a temporary basis. R. Bugala <br />moved to allow a temporary shed to be put up (16' by.12') assuming it is <br />8' high and me-ets the code for the height and that tfie shed be up for no <br />longer than 1 year from this date and that by November 12th next year it will <br />have to be down whether the garage is constructed or not, seconded by R. <br />Grace, and unanimously approved. Variance granted. <br />9. John and Mary Piter, 4505 Porter Rd. <br />Request for variance (1133.13). Request 428 sq. ft. variance for shed and <br />location variance for shed. Violation of Ord. 62-33, Section 1151.04-D. <br />(Please note: existing 432 sq. ft. legally non-conforming workshop on property) <br />Chairman Remmel called all interested parties before the Board. The oath was <br />administered to Mr. Ponte, a neighbor, and Mr. Piter who explained that there <br />is a work shop on the property and he needs the shed for storage. Property is <br />500 feet deep and shed would be located adjacent to the work shop. Shed is <br />96 square feet and conforms.to the ordinance. Board has no problem with <br />location. Board discussed what variance is actually required since the 432 <br />square foot work shop is legally non-conforming. Law Director Gareau stated <br />that since work shop is legally non-conforming, he would really only need a <br />96 square foot variance. Mr. Ponte: has no problem with the shed or the <br />location. R. Bugala moved to grant the 96 square foot variance for the shed <br />and also a variance for the location of the shed which is to be.50' behind <br />the existing house, seconded by B. Grace, and unanimously approved. Variances <br />granted. <br />10. The Kenny King Corp.oration, 27899 Lorain Rd. <br />Request for variance (1133.13). Request 44 sq. ft. variance for pole sign.
