?.., r <br />' PLANNING COMMiSSION APRIL 8, 1986 PAGE 5 <br />stated, in part, that when he purchased the property in 1970 he was lead <br />to believe that it had been properly subdivided; he was also told that <br />he could acquire the property to the rear of sublot 1 in order to develop <br />it; he has been unable to purchase this land, although he has tried on <br />many occassion. Variance to build a house on sublot-1 were granted by <br />the Board of Zoning Appeals both in November of 1980 and in January 1983 <br />( it had not been determined at that time that property was not legally <br />subdivided); however, since the house was never built, these variances <br />have expired. Mr.-Gibbons claims that if lot is not developed it will <br />remain an eyesore to the neighborhood so they are requesting a reconsid- <br />eration of the proposal. Mr. Schaller pointed out that sublot 2 is <br />nonconforming because it does not have minimum frontage and sublot 1 <br />is nonconforming because it does not meet depth requirements. Mr. <br />Modenbach, a neighbor across the street from sublot 1, presented a <br />statement with the signatures of 12 neighbors who are opposed to the <br />proposal since it would be impossible to construct a conforming house <br />on this property. Mrs. 0'Dell, who ownes property behind sublot 1, <br />stated-that she will never sell part of her property to Mr. Bauer and <br />that she had never given him_the impression that she would. -Mr.- <br />Aarrington, owner of sublot 2, objected that he had not received notice <br />of this--meeting. Mr. Gibbons was notified as the representative of the <br />proposal. T. Morgan moved to approve the Bellevue Fitch lot split, <br />subdivision of parcel 235-18-14 into two parcels 235-18-14 and 235-18- <br />113. Mr. Dubelko advised that this proposal would have to be referred <br />to the Board of Zoning Appeals. Mr. Morgan withdrew his motion. Mr. <br />Morgan moved to refer the.Bellevue Fitch lot split, subdivision of par- <br />cel 235-18-14-into two .parcels and 235-18-113; be referred to the Board <br />of Zoning _Appeals _-wi.th=- the r.ecommendation= that.- :the 1Dt "split= be- denied-_- --= <br />because it would create a- non-conforming- lot,._seconded _by-.E. Traczyk; -- <br />and unanimously approved. <br />-V. COMMUNICATIONS: <br />Notice of seminar on planning and zoning to be held in Colorado Springs, <br />Colorado. <br />VI. COMMITTEE REPORTS:- <br />In reference to the Fretters proposal, Mr. Burns advised that the Transpor- <br />tation Study Committee is considering the elimination and vacation of <br />Sparky Lane. They will be meeting before the next Planning Commission <br />meeting. <br />IX. ADJOURNMENT: <br />Mr. Burns moved to excuse the absence of B. Gorris and J. Wixted,-seconded <br />by R.
