, <br />e-i <br />CITY OF NORTH OLMSTED <br />BOARD OF BUILDING CODE APPEALS <br />MINUTES - MAY 22, 1986 <br />I. ROLL CALL: <br />The meeting was called to order at 7:56 p.m. <br />Present: M. Gates, J. Kazak9 and B. Schulz <br />Absent: R. Burk and R. Grace. <br />Also Present: Building Commissioner Spino and Recording Secretary B. Oring. <br />II. REVIEW AND CORRECTION OF MINUTES: <br />B. Schulz moved to approve the Minutes of February 27, 1986 as submitted, <br />seconded by M. Gates, and unanimously approved. <br />III. NEW BUSINESS: <br />No items. <br />IV. OLD BUSINESS: <br />Mr. Kazak advised that the Board met at the Corporate Center to inspect <br />the earth station which had been approved by the Board previously. It had <br />been -necessary to move the -installation_ about 6._.to. 8'_' south in order to <br />instail_the dish properly.- =The dish -is -appr-oximately_ 6"higher =thail was -=originally approved, b ut the Board see no problem with it. - <br />Mr, Schulz read an article regarding satellite earth stations which stated <br />that local zoning authorities can ban back yard or roof top satellite dishes <br />only when the TV receiving equipment vioTates a reasonable and clearly de- <br />fined health, safety, or aesthetic consideration according to a ruling of <br />the Federal Communications Commission; and further stated that local officials <br />could not enact zoning restrictions as a pretex for helping broadcasters <br />and cable operators to keep or build an audience. This Board has requested <br />that the administration review the satellite ordinance. Mr. Schulz suggested <br />that this Board contact the FCC for all their rulings pertaining to these <br />dishes. Mr. Spino agreed.that this ordinance is too restrictive and that <br />the City should look into revising it. Ms. Petko, manager of Curtis Mathes, <br />will be at a later meeting to provide additional information. The Board <br />agrees that there should be separate standards for commercial and residen- <br />tial dishes. Mr. Schulz advised that, according to an article in Popular <br />Science Magazine, dishes will be smaller in the future. He also agreed to <br />eontact the FCC for any information that they might have. <br />Building Commissioner-Spino also would like the Board to study the sign <br />ordinance since he believes that the present ordinance is not fair in all <br />instances; he also suggested that perhaps ground sign;s should not be per- <br />mitted on corner lot because they have been a problem at times.
