<br />CITY OF NORTH OLMSTED <br />BOARD OF ZONING APPEALS <br />MINUTES - DECEMBER 4, 1985 <br />Chairman Remmel called the meeting to order at 7:40 p.m. <br />Present: R. Bugala, R. Gomersall, E. Graves, and C. Remmel. <br />Absent: J. Helon <br />Also Present: Law Director M. Gareau, Building Commissioner E. Gundy and <br />Recording Secretary B. Oring. <br />R. Gomersall moved to approve the minutes of November 13, 1985 as read, <br />seconded by E. Graves, and unanimously approved. <br />Joseph F. Stralka, 25904 Byron Dr. <br />Request for ruling (1133.13). Request ruling if camper trailer parked <br />in corner lot set back is legal according to Ord. 62-33, Section 1151.04 (K). <br />(Withdrawn from meeting of November 13, 1985). <br />Chairman Remmel called all interested parties before the Board. The oath <br />was administered to Mr. Stralka. Chairman Remmel read a petition signed <br />by thirty two people opposing the variance. Trailer is parked in the side <br />yard on a corner lot (facing Lydgate). Mr. Stralka has planted white pines <br />to block the view and claims this is his side yard and the ordinance reads <br />he can park a trailer there. Mr. Remmel stated that trailer is in view of <br />the street and there is room to park it in the rear yard. Mr. Stralka <br />stated that the trailer would still be visible from the street if parked <br />in the rear yard. He also pointed out that the petition states that he is <br />seeking a variance and not a ruling, the signees were under the impression <br />that he was all ready illegal;petif,ion was not presented properly. C. <br />Remmel moved that the request for a ruling favorable to parking the camping <br />trailer in the side yard in this corner lot be rejected, seconded by E. <br />Graves, and unanimously approved, Law Director Gareau advised that this <br />ruling would be subject to review by Council within thirty days. <br />1. Hennie Homes, property located west of John Knox Church (25200 Lorain Rd.) <br />(50' required for both S,R.252 and Lorain Road per ruling of the Law Dept.) <br />(Proposal denied by Planning Commission September 24, 1985). <br />(Withdrawn from meeting of November 13, 1985). <br />Chairman Remmel called all interested parties before the Board. The oath <br />was administered to F. Moss, attorney; A. Bender, architect; and P. Zwick, <br />engineer. Mr. Moss explair.ed that building had been approved by the Archi- <br />tectural Board of Review, however, Planning Commission had denied proposal <br />on the basis that a 50' set back would be required on both Lorain Road and <br />the proposed S.R.252. This 50' set back on both streets would prevent de- <br />veloping the property since it reduces the buildable width of the lot to <br />25' or less. The State has taken 25' of the original lot, reducing the <br />? width to 75'. Mr. Moss stated that if the Board adopts the 25' set back <br />they would need no variance, if the Board adopts the 50' set back they <br />would need a 22' variance.
